POSITION SUMMARY: This position is responsible for representing PCCI and its sister subsidiaries in various litigation matters including, but not limited to, employment law, OSHA matters, construction defects and collections matters, providing senior management with effective advice on improving company processes based on litigation outcomes, and other matters as they arise.


SUPERVISION RECEIVED: Works under the general guidance of the Chief Legal Officer.


ESSENTIAL DUTIES AND RESPONSIBILITIES: include the following. Other duties may be assigned.


  • Represents PCCI and/or its sister subsidiaries in (i) wrongful termination, wage and hour, PAGA and other employment-related litigation; (ii) pursuit of accounts receivable in a residential and/or commercial construction setting; (iii) OSHA citations; (iv) construction defect matters; and (v) other litigation issues as they arise.
  • Advises all levels of management as well as field personnel at both of the parent’s and subsidiaries’ levels on legal matters and legal implications of all matters.
  • Conducts research for both transactional and litigation matters as needed.
  • Oversees, manages and strategizes with outside counsel in relation to class actions and other complex litigation.
  • Ensures compliance or recommends alternative actions as required to conform with legal, contractual, corporate and risk management policies to minimize and limit corporate liability, manage risk, and optimize value of contracts.
  • Participates in the definition and development of corporate legal policies, procedures and programs for both PCCI and its sister subsidiaries.
  • Coordinates responses to subpoenas.


QUALIFICATIONS To perform this job successfully, an individual must be able to perform each essential duty satisfactorily. The requirements listed below are representative of the knowledge, skill, and/or ability required.

  1. Education/Experience: Juris Doctor (J.D.) or equivalent and five (5) years of related experience and/or training or equivalent combination of education and experience.
  2. Language Ability: Ability to read, analyze, and interpret common scientific and technical journals, financial reports, and legal documents. Ability to respond to common inquiries or complaints from customers, regulatory agencies, or members of the business community . Ability to write complex reports, business correspondence and procedure manuals. Ability to effectively present information to top management, boards of directors, and public groups.
  3. Reasoning Ability: Ability to define problems, collect data, establish facts, and draw valid conclusions. Ability to interpret an extensive variety of technical instructions in mathematical or diagram form and deal with several abstract and concrete variables.
  4. Computer Skills: Must be able to operate a personal computer plus related software and other various standard office machines and equipment necessary to complete duties.
  5. License: CA Bar License required .


PHYSICAL DEMANDS The physical demands described here are representative of those that must be met by an employee to successfully perform the essential functions of this job.


  • Reach with hands and arms. Talk and listen, Stand, walk, and sit. Able to use a computer for significant time throughout the day.
  • Occasionally required to bend at the waist. Lift and/or move up to 20 pounds.
  • Depending on litigation load and locations, travel time may be required.
  • Regular in office attendance is required.
