The Special Prosecutions Division is responsible for prosecuting complex and specialized criminal cases throughout New Mexico. The Division specializes in handling cases related to internet crimes against children, child exploitation, violent crimes, fraud, and government accountability. The Special Prosecutions Division provides assistance and trial support to local prosecutors and law enforcement, and provides training for federal, state, and local agencies. In addition, the Division performs prosecutorial reviews of officer involved incidents.

 Why does the job exist?
 
Attorneys in the Special Prosecution Division establish a standard of excellence in the prosecution of various crimes throughout the State of New Mexico. Attorneys handle these matters from the intake/charging phase all the way through trial. Attorneys within the division carry a manageable caseload that allows time for collaboration with other attorneys in the division, consultation with experts, and trial preparation using expert jury consultants.
 How does it get done?
 
Key responsibilities are to prosecute criminal cases from screening to final disposition. This includes recommending charging decisions, motions practice, criminal litigation and trial. Prosecuting attorneys are expected to collaborate with law enforcement agencies throughout the state as well as Department of Justice Special Agents. They are expected to travel as needed within the state for pretrial interviews, courtroom appearances and other matters. Prosecuting attorneys also have the opportunity to give and participate in specialized trainings related to criminal prosecution.

Prosecuting attorneys at the NMDOJ represent the State in criminal matters. They must also ensure the protection of the rights of the crime victims.

 Minimum Qualification
 
Juris Doctorate degree from an accredited school of law and two (2) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA).  Employment Requirements
 
Must possess and maintain a current Defensive Driving Course Certificate from the State of New Mexico or must pass and receive Defensive Driving Course Certification as a condition of continued employment as some statewide travel maybe required. Employment is subject to criminal background check and is conditional pending results of criminal background check. Be of good moral character and not have been convicted of a felony offense by a court of this state any other state or the United States
 Working Conditions
 
Working conditions are an office setting with exposure to visual/video display terminal. Hybrid work from home options are available. Some exposure to sensitive visual media may be required. Courtroom appearances are frequent. Occasional in-state travel required.

This position exists to actively investigate and conduct complex financial, analytical and/or criminal high impact tax cases within various tax programs enforced by state laws, rules and regulations. Special Agents are commissioned law enforcement officers, responsible for planning and directing multi-subject and/or complex tax fraud/evasion, criminal financial or money laundering investigations.
 How does it get done?
 
This position will be responsible for: 
<ul>
<li>Investigating alleged or suspected violations of federal and/or state laws, rules and regulations.</li>
<li>Conducting interviews, interrogations, undercover operations, surveillance activities, research, review and analysis of public, confidential records and financial records in compiling evidence of violations.</li>
<li>Maintaining contact and works with other law enforcement officials at the federal, state, and local levels in planning and coordinating investigations, gathering intelligence, and determining priorities for conducting operations.</li>
<li>Coordinating complex financial/analytical investigations/criminal analyses and trains and develops staff in investigating procedures, interrogation, and criminal analysis.</li>
<li>Conducting tactical analysis of complex criminal cases and organizes large amounts of diverse information into concise analytical form.</li>
<li>Obtaining signed statements and affidavits, prepares and serves search warrants, makes arrests, and serves legal documents as required.</li>
<li>Providing expert testimony in administrative, civil, criminal, or other proceedings concerning investigative findings.</li>
<li>Assisting prosecutors in filing charges in criminal court proceedings.</li>

 Minimum Qualification
 
Bachelor's degree from an accredited college or university in Business or Public Administration, Accounting, Finance, Economics, Criminology, Criminal Justice, Police Science, Political Science, or other related field and three (3) years of experience in law enforcement, criminal and/or white collar or economic/financial fraud investigations. Any combination of education from an accredited college or university in a related field and/or direct experience in this occupation totaling seven (7) years may substitute for the required education and experience. Must be a New Mexico Certified and Commissioned Law Enforcement Officer (Police Officer), or be eligible for Certification by Waiver, subject to the provisions of Chapter 29, Article 1 NMSA 1978, as set forth in 29-7-6 NMSA 1978, 29-7-10 NMSA 1978 and 10.29.6 NMAC, and as specifically enacted in statute, as established by the New Mexico Legislature, conferring statutory authority upon an agency to appoint, employ, and commission Police Officers pursuant to the provisions of Chapter 29 NMSA 1978 or pursuant to NMSA 1978, 60-13-9(G), 70-5-20 and 60-14-4(T).

Ability to lift 25lbs, extended periods of sitting, travel out of town as necessary and extensive computer and telephone usage.  Why does the job exist?
 
The purpose of this position is to oversee and provide a steady flow of tax cases for criminal investigations. This involves developing, reviewing, filtering and analyzing information received from various sources, making recommendations for criminal investigation and maintaining administrative control of all cases considered by the Tax Fraud Investigations Division (TFID). This position is responsible for the civil closing of criminal investigations. This position acts as the primary technical advisor to TFID Special Agents and prosecuting attorney during criminal proceedings, as an expert and summary witness.
 How does it get done?
 
This position will be responsible for: 
<ul>
<li>Development of tax fraud allegations from the public, internal and other sources for potential criminal investigation.</li>
<li>Must have the ability to analyze various types of accounting records, tax filings, public records and other miscellaneous sources of information to determine whether criminal tax violations have occurred or whether the information should be referred for audit.</li>
<li>Support the Special Agents in criminal tax investigations as the accountant and tax law expert which includes participation in witness interviews, conferring with the prosecuting attorneys, testifying in grand jury/trial and preparing requested schedules for trial (as needed).</li>
<li>Responsible for the civil closing of criminal investigations.</li>
<li>Acts as the primary technical advisor to Tax Fraud Investigations Division (TFID) Special Agents and as an expert and summary witness for the prosecuting attorney during criminal proceedings.</li>

 Minimum Qualification
 
Bachelor's Degree in Accounting, Finance, Business Administration, or Taxation to include eighteen (18) semester hours of accounting or auditing (six (6) semester hours in finance or business law may substitute for up to six (6) semester hours of accounting or auditing) and two (2) years of experience in Auditing, Accounting, Taxation, Collections, and/or Finance. Four (4) years additional experience in related fields may substitute for the required Bachelor's degree. Possession of a Certified Public Accountant (CPA) certificate issued by the New Mexico Board of Public Accountancy may substitute for the required hours in accounting.
