<br>Lincoln County is looking for a Deputy District Attorney (DDA 2 or 3) to assist in representing the State of Oregon as a trial lawyer especially as it pertains to the Justice Reinvestment Act. The person in this role will also be responsible for providing legal advice and assistance to law enforcement agencies in investigations at all hours of the day and night. The role of Deputy District Attorney 2 or 3 will also advise, counsel, and conduct special training for Deputy District Attorneys and all law enforcement agencies.$82,927.00 - $123,705.00 annually**Lincoln County follows Oregon Pay Equity laws in reviewing education and experience for wage offer. EXAMPLE OF DUTIES
<br><b>Charge and prosecute crimes in Lincoln County:</b> Determine whether investigations are complete and sufficient for charging. Analyze police reports and evidence of search warrant affidavits, review legal issues and request further investigations, if necessary. Interview, prepare, and subpoena witnesses to testify.Prepare cases and paperwork for filing in the courts.Responsible for negotiating with the defense bar.Alert the District Attorney to potentially high profile or sensitive cases.Manage all formal and bench probation cases. Initiate motions to revoke probation, motion/order to show cause, subpoena witnesses, represent the State in probation revocation hearings and recommend sanctions if found in violation of probation. Analyze probation violation reports to determine whether to proceed with probation violation hearings, initiate and prosecute probation revocations arising out of felony convictions. Review presumptive prison cases with Community Justice Department to determine whether an offender could be safely supervised in the community on a downward dispositional departure. Meet with prospective downward departure candidates with approval of defense counsel and discuss the downward departure program and requirements. Meet with Community Justice staff to provide a Prosecutors perspective on case work and if the offender is meeting the goals of supervision.Prepare for and appear in hearings, trials, court arraignments, and other miscellaneous proceedings, covering for other attorneys, when necessary.Provide assistance and advice to law enforcement and other partner agencies in investigating cases: Assist and advise law enforcement agencies.Provide, on a scheduled basis, off hour, 24 hour a day on call service to law enforcement agencies requiring assistance during nights or weekends for major crime and crash teams. Respond to crime scenes if asked by law enforcement agencies and at the direction of the District Attorney and/or Chief Deputy District Attorney.Provide legal information to law enforcement in regard to unattended deaths, releases body or determines if more investigation of a crime is necessary.Other functions: Attend statewide and local meetings to discuss the value of the Dedicated Prosecutor model and discuss the working relationship between Community Justice and the District Attorney’s Office. <div><div>The Deputy State&rsquo;s Attorney performs routine professional legal work in the prosecution of civil and criminal crimes, juvenile crimes, and juvenile abuse and neglect cases in Lincoln County. Actual responsibilities of the Deputy State&rsquo;s Attorney vary dependent upon vacant position but may include reviewing offenses and evidence to make determination on charges and prosecuting violations of state law, reviewing requests for petitions and determining appropriate course of action, communicating with victims, law enforcement officials, and other individuals about cases, making recommendations for child custody and parental rights, and attending legal proceedings.</div><div>

Prepare and manage a caseload of predominantly misdemeanor cases, low-level felonies, juvenile violation cases, and juvenile abuse and neglect cases. Present cases for legal proceedings. Perform legal research. Prepare, draft, and file legal documents and correspondence.</p><p>
? Review offenses, police reports, and evidence to make determination on charges. Prepare, send, and track subpoenas for witnesses and records. Prepare and interview witnesses for legal proceedings. Select jurors.</p><p>
? Stay informed on changes in relevant laws, statutes, and proposed legislation and policy pertaining to criminal law, juvenile delinquency, and juvenile abuse and neglect. Draft proposed legislation and appear before legislative committees.</p><p>
? Communicate, correspond, and collaborate with parties involved in cases including victims, parents, school personnel, attorneys, court personnel, and law enforcement regarding procedures and actions for those cases. Respond to inquiries from the public and the media.</p><p>
? Make recommendations for custody, parental rights, sentences, and restitution.</p><p>
? Represent the State&rsquo;s Attorney&rsquo;s Office at public, private, and inter-governmental programs and events, communicate with the media, prepare press releases, and serve on boards, panels, and task forces.</p><p>
? Train and educate volunteers, law enforcement, and social workers on their roles and duties on legal issues and the court process duties. Train interns. Supervise clerical staff and interns.</p><p>
? Answer, handle, or direct phone calls and walk-in traffic from clients and the general public regarding legal concerns and questions.</p><p>
? Occasional travel between work sites.</p><p>

Graduation from a college of law, attainment of a Juris Doctorate degree from an accredited law school, and admission by the Supreme Court of South Dakota to practice law in the state of South Dakota or be licensed to practice law in any other state and able to take the next available South Dakota bar examination or be a recent or imminent law school graduate, eligible to sit for the next available South Dakota bar examination. Comparable combination of education and experience may be considered.</p><p>
