Working collaboratively with the Human Resources Director and project team, this position is essential in driving positive employee relations strategies, leading partnering with leadership and on-site managers related to employee issues. They are responsible for leading through employee relations matters including employee complaints, investigations, conflict, and performance management, and making recommendations on solutions. They also develop proactive approaches to mitigate challenges and educate managers on their people leadership skills. RESPONSIBILITIES</b></div><ul><li>
Provides counsel and support to managers/supervisors on issues of company/HR policy application, production operation Human Resource needs and provides HR services to team members.</li><li>
Identify, investigate, and resolve issues of employee concern or conflict in an appropriate, compliant, and timely manner. Scope concerns may be related to code of conduct violations, ethics matters, performance, safety, interpersonal conflict, general conduct, and employment action concerns.</li><li>
Maintain detailed and accurate account of concern or investigation with timely memorialization of the notes and supporting documents, using the appropriate processes and systems.</li><li>
Consult with the HR Director, Labor &amp; Employment, Legal and HR resources, and managers in providing the HR support and employee relations subject matter expertise to recommend solutions and action to resolve employee concerns.</li><li>
Provide regular and proactive communication to Leader and other relevant parties, related to assigned cases.</li><li>
Conduct ER investigations, analyze organizational health issues, and work in partnership with the HR Business Partner to develop and execute plans to address problem areas.</li><li>
Use data and information gathered from investigations to determine appropriate course of action aligned with company policies and procedures.</li><li>
Coach leaders on appropriate follow up and disciplinary action as needed based on findings of performance and/or employee relations concerns.</li><li>
Apply expertise supporting managers and employees through ADA accommodations processes.</li><li>
Maintain a strong partnership with the safety teams to support safety incidents.</li><li>
Facilitate field-based training in support of positive employee practices and relations.</li><li>
Utilize a customer-focused approach to deliver HR solutions through effective partnerships across the HR department and business unit.</li><li>
Utilize influencing skills with managers to reach win/win outcomes that minimize risk to the company.</li><li>
Provide recommendations on promotions, development opportunities, and participation in learning programs.</li><li>
Conduct employee exit interviews, analyze and capture trends, and make recommendations.</li><li>
Produce, review, and analyze a variety of data to support decision making, share outcomes, and help influence solutions.</li><li>
Assists with general and administrative HR duties as assigned, specifically related to onboarding, data, and reporting.</li></ul><div><b>
QUALIFICATIONS</b></div><ul><li>
Bachelor&rsquo;s Degree Required with 3-5 years&rsquo; experience in HR with a focus on Employee and/or Labor Relations and manager coaching.</li><li>
Specific experience with conflict management and leading through investigations.</li><li>
Demonstrated knowledge of labor, federal and multi-state regulations.</li><li>
Outstanding interpersonal skills with the ability to build quick relationships across multiple levels.</li><li>
Exceptional written and verbal communication skills.</li><li>
Detail oriented with strong organizational skills.</li><li>
Proven ability to solve complex challenges, leveraging solid critical thinking skills.</li><li>
Must navigate sensitive situations and maintain a high degree of confidentiality.</li><li>

Human Resources Generalist

McCarthy Building Companies, Inc., is currently searching for a Corporate Counsel to support its Southern Region. This position will be located in our Dallas, Texas office and will report to the Vice President Legal. The Corporate Counsel position entails being a team member in a forward-thinking, dynamic Legal Department that is highly integrated within the organization. Our lawyers are valued and respected for their legal advice, but also for their input on the business side of the deal.</div><div>
</div><div><b>
RESPONSIBILITIES</b></div><ul><li>
Provide legal advice in all aspects of construction law, as well as ancillary legal areas applicable to a national multi-billion-dollar corporation in the construction industry, such as disputes related to contract, delay, payment, construction defect, and injuries, litigation, and insurance matters, among others.</li><li>
Provide advice on procurement matters related to public and private works construction projects in a variety of industries, procurement types and delivery methods, including federal and federally funded construction projects.</li><li>
Assist operations in disputes involving owners, architects, subcontractors and consultants.</li><li>
Conduct moderate to complex legal research on a variety of topics in multiple states that relate to the business.</li><li>
Manage subcontractor defaults; work with operations to ensure that McCarthy&rsquo;s interests are properly protected by subcontractors&rsquo; bonding companies; assist in managing litigation arising out of any breach of payment or performance bonds.</li><li>
Provide advice on the Company&rsquo;s labor strategy in connection with existing labor agreements, project labor agreements as well other project labor requirements, including prevailing wage and apprenticeship ratios.</li><li>
Assist in communications with national, state and local regulatory agencies, such as Occupational Health and Safety Administration, Storm Water Regulatory Agencies, and the National Labor Relations Board.</li><li>
Draft memoranda, correspondence, and reports summarizing research findings and offer opinions regarding liability, risk transfer and exposure.</li><li>
Assist in identifying and managing complex builder&rsquo;s risk insurance, professional liability insurance and general liability insurance issues on a variety of different project types in both pre-litigation and litigation situations.</li><li>
Assist project teams in understanding and pursuing insurance coverage for construction defect, builder&rsquo;s risk, pollution, professional, auto, worker&rsquo;s compensation and property damage claims while working in conjunction with the Risk Management Department.</li><li>
Assist with all aspects of litigation - respond to document requests, prepare discovery responses, review and edit motions, briefs and memoranda from outside counsel; manage outside counsel throughout the pre-litigation and litigation processes.</li><li>
Assist in preparation for and attend alternative dispute resolutions.</li><li>
Provide general legal advice to McCarthy team members.</li></ul><div><b>
QUALIFICATIONS</b></div><ul><li>
Juris Doctorate from an ABA accredited law school</li><li>
Licensed to practice law in at least one state in the United States, preferably Texas</li><li>
Minimum of 5 years of experience as an attorney</li><li>
Experience with construction law as well as familiarity with design and construction agreements is a plus</li><li>
Ability to communicate with other members of the legal department articulately, concisely, and with well-reasoned opinions</li><li>
Ability to communicate complex legal concepts to non-attorney McCarthy team members in a concise, yet thorough, manner</li><li>
Excellent verbal and written communication skills</li><li>
