 The Deputy Attorney General serves as a legal advisor and litigator, providing legal guidance to state agencies and represent the state in court or high-level negotiations. The role combines strategic legal leadership with public service, ensuring that state laws are enforced fairly and effectively. The Appeals Division of the Attorney General’s Office represents the State, its agencies, officers, employees, and interests, before the state and federal appellate courts and in federal district courts in habeas corpus proceedings. The Division is comprised of two sections: civil and criminal.The Civil Appeals Section represents the interests of the State of Indiana, state agencies, and state officials in appeals of civil decisions in state and federal courts addressing an array of issues including, but not limited to child welfare, eminent domain, constitutional challenges to statutes, and habeas corpus matters involving prison discipline. The Criminal Appeals Section primarily represents the State of Indiana in criminal appeals brought in the Indiana Court of Appeals and Supreme Court. Though this position will work primarily in the Criminal Appeals Section, the Division regularly assigns cases of all types across the two sections and encourages attorneys to take appropriate cases outside their usual practice area to expand their skills and understanding of the breadth of the State’s interests and obligations.
 
EXAMPLE OF DUTIES
 The Criminal Appeals Section handles all appeals from state trial courts in criminal matters and federal habeas litigation challenging Indiana convictions and sentences. A Deputy Attorney General assigned to the Section carries a substantial caseload. The Deputy is responsible for all aspects of the appeal: confirming deadlines and scheduling, communicating with stakeholders, motion practice, briefing, oral argument, and post-decision review and proceedings. All representation must conform with the Rules of Appellate Procedure, division style and format practice, office policies, professional conduct rules and expectations, and all other applicable laws, standards, and guidelines. The Deputy is primarily responsible for the cases assigned, until an appearance is withdrawn, or employment has concluded. All deputies assist other attorneys preparing for oral arguments by participating in moot courts. Other duties may be assigned. Other duties may include responding to prosecutor inquiries, advising special practice areas such as extradition, assisting in other cases and proceedings (including civil cases), research projects, supervision of law clerks, and the occasional administrative assignment.

Deputy Attorney General - Criminal Appeals

JOB
 The Investigator is responsible for collecting data/evidence from all available sources, taking photographs, statements, video and audio recordings and when necessary, conducting surveillance in locations throughout the state of Indiana. The Investigator will handle complaints and inquiries from the public and will need to manage a high-volume case load, which can include some criminal investigations.

 Collecting data/evidence from all available sourcesObtaining documents such as medical records, patient files, business records and other records to be used as evidence in administrative or judicial proceedingsResearching/evaluating documentationLocating, conducting surveillance of and interviewing witnesses, suspects, and possible expert witnesses in locations throughout the state of IndianaTaking photographs, statements, video and audio recordingsPreparing written and recorded statements and evaluate testimony for credibilityPreparing comprehensive investigation reports for presentation to a Deputy Attorney General or state or federal prosecutor for criminal referralsAssisting the Deputy Attorney General or state or federal prosecutor in preparing the case for courtLocating and serving subpoenas on witnesses and suspectsTestifying in criminal and administrative proceedingsCompleting any necessary component of the Indiana Law Enforcement Academy Participating in investigator training and performing other work as required.Such travel as the assignment of duties may necessitate, usually consisting of frequent trips totaling more than 1000 miles per month, for the following purposes: Conduct investigations at the business and home locations of Medicaid providers and at the home locations of Medicaid recipients. Travel to state offices, jails, police departments, sheriff’s departments, courthouses, offices of businesses contracting with healthcare providers, and such other locations as may be necessary for the purpose of obtaining documents, statements, and other evidence necessary to an investigation. Travel to surveillance locations and conducting surveillance from a vehicle for extended periods of time in all types of weather and at all times of day or night.Travel to and assist in serving search warrants and seizing evidence at such times as is best for the purposes of the investigation, including times beyond normal duty hours, and to transport to such sites the supplies and tools, including storage boxes and document scanners, as may be required.Travel directly from home to the office of a healthcare provider under investigation, to an office of the Medicaid Fraud Control Unit other than the assigned duty station, or to other locations required by an investigation, as may be necessary to the efficient and effective completion of an investigation.
