Basic Function</b></div><div><br>
This is an appellate position in the Office of Attorney General&rsquo;s Criminal Law Division. The Appeals and Grand Jury Section represents the Commonwealth in direct appeals from criminal convictions, in proceedings under the Pennsylvania Post Conviction Relief Act, and in federal habeas corpus litigation. The section also provides legal advice and support to other attorneys, both in the Office and throughout the Commonwealth, on matters relating to law enforcement. The section&rsquo;s work arises from prosecutions within the Office&rsquo;s jurisdiction, as well as referrals from local District Attorneys due to a lack of resources or a conflict of interest.</div><div></div><div><br>
The primary job requirement is excellent written and oral advocacy skill. Attorneys must also be able to exercise sound prosecutorial judgment and to manage an independent caseload. Although attorneys will be headquartered at a specific location, some travel will be necessary for appellate arguments and for hearings in state post-conviction and federal habeas actions.</div></div><br>

The Office of Attorney General&rsquo;s (OAG) Organized Retail Crime Unit (ORC) is a subdivision of the Organized Crime Section in the Criminal Law Division. The ORC Unit investigates and prosecutes complex criminal enterprises engaged in the intentional theft of retail goods for the pure profit of the organizations.</div><div></div><div><br>
An employee in this position is responsible for performing duties which include the receipt/retrieval, analysis, and compilation of data and the verification and dissemination of information of a confidential and sensitive nature in a variety of ways pertinent to investigations and prosecutions into organized retail crime. This includes providing information to the agents and attorneys in the ORC Unit for a variety of purposes including both investigation and litigation support. The employee is responsible for assisting with/conducting the retrieval, compilation, and summarization of information needed by Special Agents and prosecutors in the course of an investigation. The successful candidate will work closely with the attorneys to prepare court documents, organize trial exhibits, and attend court proceedings. An employee in this position will report to the Chief Deputy Attorney General of the Organized Crime Section.</div><div></div><div><br>
Assignments and supervision are received from the legal staff and/or investigative staff dependent on the nature of the case(s). Assignments progress in difficulty and complexity and are designed to provide experience in investigative analysis techniques and resources. As an Investigative Analyst I gains experience, work is performed with more independence. Employees must comply with all requirements of the Criminal History Records Information Act (CHRIA).</div></div><br>

Through this posting, the OAG is seeking an attorney to work in the Litigation Section in Philadelphia. Attorneys in this section defend claims involving civil rights, constitutional law, and employment law, while representing the Commonwealth, the OAG, the Governor, and other Commonwealth agencies, officials, and employees. The majority of cases are in federal court. Each attorney on the team handles cases from pre-complaint discovery and service of legal process through posttrial motions and consultation with the Appellate Litigation Section on any appeals. The ideal candidate is an excellent communicator, possesses strong research and writing skills, and has the ability to independently manage a full caseload. While attorneys largely manage their own cases, they will receive support and guidance from both their supervisor and colleagues. The attorney also may be teamed up with more senior attorneys on matters deemed to be more complex and difficult.</div><div></div><div><br>
A Deputy Attorney General III (DAG III) will be assigned more complex and significant cases and works independently on most matters. A Deputy Attorney General IV (DAG IV) works independently except in extraordinary cases. This Deputy Attorney General position is an advanced prosecutor position in the Office of Attorney General&rsquo;s Criminal Law Division. The Criminal Prosecutions Section investigates and prosecutes a complete spectrum of crimes ranging from the simplest of misdemeanors, to complex corrupt organizations and conspiracies, to first-degree murder cases. Many cases this section handles come as referrals from a District Attorney&rsquo;s office due to a lack of resources, or an actual or apparent conflict of interest on the part of the district attorney or their office. This position requires an attorney who has significant jury trial experience and experience handling child abuse and sex crimes investigations/prosecutions. Grand Jury experience would also be beneficial for this role.</div><div></div><div><br>
The assigned attorney is responsible for all phases of prosecution, including making charging decisions, arraignment, preliminary hearing, pretrial conference, pretrial motions/hearings, trial (bench/jury), post-trial motions/hearings, and sentencing hearings. The assigned attorney is responsible for maintaining contact with victims throughout the aforementioned stages of proceedings. A willingness to travel is an essential part of this position. An intimate knowledge of criminal law and criminal procedure is necessary to perform these duties. A Deputy Attorney General III (DAG III) will work independently on most matters.
