The mission of the WV Offices of the Insurance Commissioner is to promote a competitive and solvent insurance market with adequate consumer protection by fairly and consistently administering the insurance laws of West Virginia.</div><p>
The ideal candidate will be responsible for performing the following duties:</p><ul><li>
Under the administrative direction of the Insurance Commissioner, this position will serve as the General Counsel for the agency and will provide legal advice to the executive team and others in the agency regarding applicable statutes, rules, and regulations.</li><li>
Will perform advanced legal research, prepare legal memorandums and briefs on complex insurance issues, draft bills and rules, and other related documents.</li><li>
Analyze and summarize laws from other states related to insurance issues pending the state of West Virginia.</li><li>
This role involves representing the agency in matters before the Legislature and testifying before legislative committees regarding bills and study topics, as well as collaborating with committee counsel on these matters.</li><li>
The selected candidate will correspond with legislators and the public as needed when inquiries are received.</li><li>
Manages all outside litigation and personnel matters before administrative bodies.</li><li>
Performs other duties as assigned.</li></ul><div></div><div><br>

<p></p><div><div><b>Training: </b>Admission to practice law in the State of West Virginia.</div><div>

Experience: </b>Nine years of full-time or equivalent part-time paid experience in the practice of law, including trial experience in administrative or judicial proceedings.</div><div><b>
Substitution: </b>One year of full-time or equivalent part-time paid employment as an attorney with the agency to which assigned shall be considered the equivalent of two years of other qualifying experience.</div><br>

 </ul>
 Performs legal work under the general supervision of the Associate General Counsel. Performs full performance legal work for the WV Lottery Commission. Assist Associate General Counsel with legislative bill drafting emergency policy, and procedural rules.
 <br/>
 <br/>
 Draft pleadings and other legal memoranda in litigation and administrative hearings. Will prepare legal memos on regulatory and compliance matters. Participate in the RFP contract process, interpreting purchasing rules and regulations, and providing legal guidance to management.
 <br/>
 <br/>
 Respond to FOIA requests. Research regulatory matters in the direction of the Associate General Counsel and the Lottery Director. Reviews and approvals of a variety of contracts relating to marketing, security, licensing, finance and administration, etc. Consults with agency staff on the interpretation of court opinions, the interpretation and application of statutes, rules and regulations, commission and director policy, minimum internal controls, casinos internal controls and house rules.

 Applicants are subject to an extensive background investigation by the WV Lottery Security Division. No person shall be appointed, employed, or continue to serve in any position or employment with the commission who has been convicted of any violation of the lottery law or of any felony or any crime related to theft or gambling. The commission shall remove or discharge any person so convicted.
