Advocate for a real estate company typically handles title due diligence, documentation, compliances (including RERA), and property-related disputes in-house and with external stakeholders.
Key responsibilities
- Conduct title verification and due diligence for lands and built-up properties, including review of past sale deeds, ECs, revenue records, and litigation searches, and issue clear title opinions.
- Draft, vet, and negotiate documents such as MOUs, JDAs, development agreements, sale agreements, sale deeds, agreement to sell, construction agreements, POAs, lease and leave & licence agreements, allotment letters, and cancellation deeds.
- Ensure compliance with RERA, Registration Act, Stamp Act, local municipal and development regulations, and other applicable real estate, contract, and taxation laws for all projects.
- Coordinate and liaise with government departments and authorities for approvals, registrations, conversions, and other statutory processes related to projects.
- Support marketing and sales teams by vetting brochures, advertisements, website content, payment plans, and offers to ensure legal compliance and avoid misleading representations.
- Handle property registrations at SROs, including document execution, stamp duty guidance, and closure of registration formalities for customers and landowners.
- Manage and respond to customer legal notices, broker disputes, and third-party claims; draft replies, settlements, and other communications.
- Represent the company in civil courts, RERA, consumer forums, and arbitration through own appearance or coordination with external counsel; prepare case notes, affidavits, and documentation.
- Maintain updated document management and legal records for all projects, including contracts, title documents, opinions, approvals, and litigation files.
- Monitor legal and regulatory changes in real estate and advise management on risk mitigation, structuring of new projects, and policy updates.
Candidate profile
- Qualification: LL.B (mandatory); LL.M in Property / Business Law preferred.
- Knowledge: Strong understanding of property laws, RERA, Registration and Stamp laws, contract law, local land and revenue laws, zoning and development regulations.
Skills:
- Excellent drafting, vetting, and negotiation skills for real estate contracts.
- Strong analytical ability for title and due diligence.
- Good communication in English and local language for coordination with customers, officials, and internal teams.
- Ability to work independently, handle multiple projects, and meet deadlines.
