Assistant City Attorney

Position Summary: Under general supervision, this position is responsible for advising City Council, City departments, and boards and commissions in addition to prosecuting municipal code violations in Municipal Court consistent with the organization’s values and mission statement. Has responsibility for a significant caseload in other state and federal courts and represents the City in litigation.

Supervision Exercised and Received: Position works under the direct supervision of the City Attorney.

Essential Job Functions:

Legal Consultation

• Confers and advises City departments in a timely manner. Advises and represents the City of Aspen and City departments in administrative hearings, public hearings and meetings. • Researches legal problems and may prepare, review and examine contracts, agreements, ordinances or other documents for City departments. Supports City Departments in code enforcement acitons, including drafting summons and compliants, advising code enforcement officers, and prosecuting code violations in Municipal Court and any other applicable venue. Assists with City Council, boards, and commissions on a variety of legal matters including but not limited to the legal implications of any action, inaction, or decision which may include attendance of meetings as requested by the City Attorney. May assist in the response to citizen inquiries regarding all type of legal issues involving City business. Represents the City of Aspen and City departments in District Court litigation at the state and federal level and on the appeals in the Colorado Court of Appeals and Colorado Supreme Court. Assists all City Departments and elected Officials in responding to Open Records Requests. Works with City Departments to ensure compliance with state law including, Colorado Open Records law, accessibility and ADA compliance, Colorado Open Meetings law, and new State legislation. Municipal Court

  • Prosecutes municipal code violations in Municipal Court.

City Attorney

  • Provides legal consultation with the City Attorney. Acts in place of, and assumes the duties of the City Attorney as directed by the City Attorney and in the absence of the City Attorney.

  • Responds to concerns and complaints in a timely, courteous, and helpful manner.

Minimum Qualifications:

Education: Doctor of Jurisprudence Degree (JD).

Experience: At least three years of experience as a practicing attorney at law.

Technical Knowledge: Must be proficient in the following areas: Microsoft Outlook Email, and a basic understanding of computers and online computer-based technology applications, which includes accessing web based platforms.

Licenses & Certifications:

  • Must possess a valid Colorado Driver’s License or be able to obtain one within 30 days of start date.

  • Must be admitted to the practice of law in the State of Colorado.


NOTE:
Any combination of experience and education that would likely provide the required abilities, knowledge and skills as determined by the City of Aspen may be substituted for the requirements above.

Preferred Candidate: Has Experience in Colorado local government law, knowledge of specialized areas of municipal law such as zoning and land use, election law, model traffic code, contract law, water law and municipal water and electric services.

NOTE: This position requires a Criminal Background Check upon hire. Employment is contingent upon successful completion of a Criminal Background Check.

Position Type and Work Hours:

  • Regular full time, hours may vary with workload.
  • Evenings/Weekends may be required depending on department needs and special projects.

Work Environment:

  • Indoors: Office environment.
  • Outdoors/Off-Site: Hearings at the courthouse. Meetings, trainings, and site visits at a variety of city facilities and areas.
