The Palm Beach County, FL, County Attorney’s Office is accepting applications for the position of Assistant County Attorney from candidates with substantial experience in construction law, real estate law, or both. The Office anticipates filling this position at the Senior Assistant County Attorney level. This position will provide comprehensive legal representation and counsel to County departments in matters related to construction or real estate, depending upon the selected candidate’s background and experience. The successful applicant will serve as a principal legal advisor in these specialized areas and may also be assigned other legal matters as required to support the diverse needs of Palm Beach County government.


QUALIFICATIONS

  • Membership in The Florida Bar is required.
  • A minimum of ten (10) years of progressively responsible experience in construction law or real estate law is preferred; however, exceptional candidates with less experience may be considered.
  • Florida Bar Board Certification in Construction Law or Real Estate Law is preferred.
  • Experience in local government law is desirable but not required.
  • Candidates should demonstrate:

– A diligent work ethic and commitment to professional excellence;

– Strong analytical, written, and oral communication skills; and

– The ability to work effectively as part of a collaborative legal team.


DUTIES AND RESPONSIBILITIES

The position’s primary focus will be on construction or real estate matters, as outlined below, with other assignments as needed.


Construction Law Assignment:

  • Serve as the Office’s construction law resource for County construction projects.
  • Draft and review construction contracts, amendments, and related project documents.
  • Provide legal counsel regarding bidding procedures, procurement compliance, contract interpretation, and construction disputes.
  • Represent the County in alternative dispute resolution proceedings and provide litigation support for construction-related matters.


Real Estate Law Assignment:

  • Manage all aspects of County real estate transactions, including acquisitions, dispositions, leases, licenses, easements, and exchanges of real property.
  • Handle complex real estate transactions associated with County development projects.
  • Draft and review loan agreements, promissory notes, mortgages, and related documentation for programs administered by the Department of Housing and Economic Development.
