Your Role:
Barnwell-Whaley seeks an associate attorney to practice with its transportation practice group. Applicants should have two to six years of insurance defense experience, strong writing skills, good client communication and reporting skills, and the ability to work independently and proactively on complex litigation. Case venues are statewide. Occasional accident, ‘rapid response’ work in the field is required.
Your Responsibilities:

Manage a litigation caseload from beginning to end, by thoroughly reviewing case facts, gathering evidence, interviewing witnesses, and conducting legal research to build a strong case strategy.

Draft and file necessary legal documents such as complaints, answers, motions, briefs, and appeals.

Conduct legal research, drafting pleadings, motions, and appellate briefs.

Conduct depositions, review and respond to discovery requests, and manage the exchange of information between parties.

Represent clients in court hearings, including opening statements, witness examinations, closing arguments, and jury deliberations.

Prepare and argue motions before the court on various legal issues.

Develop trial strategy, prepare witnesses, and present evidence in court.

Advise clients on legal options, potential risks, and case strategy throughout the litigation process.

Seeking to resolve disputes through settlement negotiations with opposing counsel.

Represent clients in appeals to higher courts if necessary.

Collaborate closely with paralegals and support staff to ensure timely management of case files and deadlines.

Working collaboratively with team members and partners to develop effective litigation strategies tailored to each client's unique situation to achieve successful outcomes.

Communicating with clients and providing timely reporting on case status.

Negotiating settlements for legal disputes.

Complying with all legal standards and regulations.
Requirements:
Your Skills and Experience:

Juris Doctor (JD) from an accredited law school.

Admission to the State Bar of South Carolina and in good standing.

Prefer 2-6 years of experience. Transportation experience is a plus.

Ability to evaluate complex legal issues, analyze evidence, and develop sound arguments.

Effective oral and written communication to present arguments persuasively in court and to clients.

Meticulous attention to detail to ensure accuracy in legal documents and case management.

Ability to conduct thorough legal research and apply relevant case law to specific situations.

Creatively identify legal strategies to address complex issues and overcome challenges.
