Under the direction of the General Counsel or Deputy General Counsel:
The Assistant General Counsel of the Government Law Advisory Section (AGC-Government Law) will supervise attorneys advising on the California Political Reform Act, California Government Code section 1090, and other conflicts-of-interest laws, the California Public Records Act, state contract administration, and employment law. As part of these duties, the AGC-Government Law will litigate or supervise the litigation of superior court lawsuits and appeals or State Personnel Board cases relating to any of the above-mentioned areas. The AGC-Government Law will also supervise a team of Legal Analysts and a Legal Support Supervisor, who manages a team of Legal Secretaries. The AGC-Government Law may also serve as the Commission’s Ethics Officer if requested by the General Counsel.

The AGC-Government Law will ensure that the Government Law Advisory Section meets the standards established by the General Counsel on supporting client operational needs, work product quality, productivity and timeliness, collegiality, and fulfillment of the duties and principles of public administration, personnel management, and supervision. The AGC-Government Law will embody and exemplify the highest standards of ethics and professionalism. The AGC-Government Law also will engage in Legal Division-wide and Commission-wide management initiatives, including but not limited to strategic planning, process improvement, recruitment and hiring, and training. The AGC-Government Law will cultivate the professional growth of their team and perform other duties as necessary or directed by the General Counsel or Deputy General Counsel.

Working Conditions

This is a statewide recruitment. This position can be filled in the following locations: San Francisco, Sacramento, or Los Angeles.

This is a hybrid position that will require the selected candidate to report to their assigned headquarter office a minimum of two (2) days a week. Hybrid positions may be eligible for telework under California Government Code Section 14200 for eligible applicants residing in California. In accordance with CPUC Telework Policy, telework arrangements are subject to change and may be reevaluated at any time.

Desirable Qualifications

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
  • Familiarity or experience with the California Political Reform Act, California Government Code section 1090, and/or common law conflicts-of-interest jurisprudence.
  • Familiarity or experience with California State contracting and the State Contracting Manual, or with other governmental contracting. This includes experience with competitive bidding, bid protests, interfacing with agencies approving government contracts, contractor noncompliance, and grant agreements.
  • Familiarity or experience with the California Public Records Act, the federal Freedom of Information Act, or other governmental sunshine laws. This includes experience with the deliberative process privilege, common interest privilege, and privacy and security protection laws in the context of governmental sunshine laws.
  • Familiarity or experience with state and federal employment and labor laws applicable to California State employees, appointees, and contractors, ideally in an organization employing represented employees.
  • Experience with first or second chair civil litigation in Superior Court, courts of appeal, or before administrative agencies, including but not limited to the State Personnel Board.
  • Familiarity with the Public Utilities Code and related statutes and regulations.
  • Strong analytical and legal research skill and methods and strong oral and written communication skills.
  • Familiarity with the roles of agencies overseeing regulated industries.
  • Strong facilitation, consensus-building, jurisprudential, and client relations skills.
  • Experience as a supervisor in the private sector or state, federal, or local government, ideally supervising represented employees.
  • Ability to balance voluminous assignments and manage highly complex caseloads at once with minimal supervision, all to the highest level of ethical and professional standards, under tight deadlines, and to achieve the same from subordinates.
  • Ability to manage numerous direct reports who possess a wide range of skill levels and responsibilities.
  • Ability to motivate and focus staff and build a cooperative, information-sharing working environment.
  • Demonstrated track record of participation in an organization’s recruitment, retention, and diversity efforts.
