Metro Detroit law firm specializing in Taft-Hartley/multiemployer benefit plans seeks an employee benefit/ERISA attorney to join a growing practice.

The attorney will provide legal counsel to defined benefit, defined contribution, 401(k), health and welfare, apprenticeship, supplemental unemployment, apprenticeship and training, as well as governmental benefit plans in a time sensitive and often fast-paced environment. The attorney will also be involved in collection litigation on behalf of the fund’s joint delinquency committees. Candidates should have an interest in ERISA, HIPAA, PPACA, IRC, Labor Law and related statutes. Position Overview

The Employee Benefits/ERISA Counsel position calls for a high energy and enthusiastic attorney with interest in the area of ERISA/employee benefits, preferably with Taft-Hartley/multiemployer plans, who is interested in working on routine as well as challenging employee benefits and related matters in a fast paced legal environment. Qualified candidates should appreciate and like diversity in their daily work and be comfortable working on a variety of projects with a large client base. Qualified candidates should also be comfortable in a fast-paced environment.

Specific responsibilities of the role includeReview of investment management and related contractual arrangements common to multiemployer plans Providing counsel regarding the application of and compliance with the Internal Revenue Code and the Employee Retirement Income Security Act as pertains to retirement, health and welfare and other employee benefit plans, programs and arrangements. Assisting in the drafting of qualified and nonqualified retirement plans, health and welfare arrangements, and other employee benefit plans, programs and arrangements. Drafting legal summaries for client and case management purposes, describing legal concerns with employee benefit plans, programs and arrangements. Working daily with the benefits group to address and assist in resolving administrative concerns, including those relating to collectively bargained plans. Handling collection litigation on behalf of multiemployer plans Drafting or editing plan documents, summary plan descriptions and other required documentation multiemployer benefit plans, programs and arrangements. Negotiating commercial agreements relating to multiemployer plan operations. Reviewing draft documents from clients and other stakeholders, and revise to reflect legal requirements as well as broader communication needs of the client. Assisting and managing responses to agency (e.g., IRS, DOL) inquiries regarding plan operations. Interfacing with agencies to assist in resolution of conflicts regarding plan operation. Advising employee benefits plans committees and board of trustees regarding operation in accordance with plan documents and applicable law. Reviewing and revising QDRO procedures, and assist in administration of procedures. Assisting in developing approach to and implementation of correction procedures for plan errors under IRS and DOL plan correction procedures. Providing advice and handling certain labor related matters, as needed. Maintaining and supporting a culture of legal compliance. Law degree from an accredited law school with excellent academics; graduation from a nationally recognized law school a strong plus. Active license to practice law in Michigan, or the ability to obtain admission into the Michigan State Bar within a year of employment.Working knowledge of the Internal Revenue Code and ERISA as pertains to employee benefit plans and program is a plus. Working knowledge of US labor and employment laws and benefit plan litigation process is also a plus. Initiative, integrity, resilience, and ability to manage multiple projects at the same time. Strong communication skills. Ability to present information to supervisors timely, clearly and concisely. Strong analytical skills. Superior organizational ability. Job Type: Full-time

Pay: $80,000.00 - $100,000.00 per year
