ATTORNEY IV

Under the direction of the Assistant Chief Counsel, the Attorney IV in the Office of Plan Licensing performs the most sensitive and highly complex legal work focusing on health care regulation and reform for the Department of Managed Health Care, including acting as a lead counsel for the Department's review of health plans' complex filings.

In addition to providing direction and leadership on plan filings, including license applications, material modifications and amendments to license applications, the Attorney IV will be tasked with the duties associated with handling "Pharmacy Benefit Management Registration" pursuant to Health and Safety Code section 1385.005. The position will significantly interact with the DMHC divisions, department management, retained outside counsel, independent experts, and third-party monitors, as required. The Attorney IV will act as OPL and the Department's subject matter expert on Pharmacy Benefit Management Registration.

The work entails legal review, legal research, transactional review of health care service plan documents, and applying the law in connection with the administration and regulation of persons licensed pursuant to the Knox-Keene Health Care Service Plan Act of 1975, including the implementation of Federal Health Care Reform. Duties involve communication with licensees and coordination with other divisions/offices on filings and matters concerning licensees. In addition, performance encompasses work relative to data collection and analysis, and other special projects, including drafting regulations and managing Department contracts with consultants, as required, and serving as lead for project teams of attorneys and analysts.

The ideal candidate has extensive experience in the field of health care regulation, with particular emphasis on the review and analysis of Section 1385.005. In addition, the ideal candidate has experience drafting and negotiating competition-related undertakings, conducting and assessing market impact analysis, presenting at public meetings, and drafting third-party monitoring vendor agreements.

Leave Program (PLP) 2025 agreement:

Effective July 1, 2025, the California Department of Human Resources (CalHR) implemented the temporary Personal Leave Program 2025 (PLP 2025). PLP 2025 directs that each employee receive a temporary reduction in pay in exchange for PLP 2025 leave credits. The temporary salary reduction percentage and the number of PLP 2025 leave credits are based on the position’s associated bargaining unit. Working Conditions

The DMHC has locations in Downtown Sacramento and Rancho Cordova. Both locations are located close to light-rail with various amenities. The incumbent will work in a climate-controlled cubicle and/or office environment with artificial lighting.

This position may be eligible for hybrid telework. The telework schedule is permitted at the operational needs of the Department and is subject to change, consistent with the State Telework Policy and the DMHC’s Telework Policy. All employees who telework are required to be California residents and maintain California residency in accordance with Government Code 14200.
