Attorney (JD) – Servicing, Workouts & Asset Management (Debt & Equity)

100% Remote - must be in a North American aligned time zone.

Kirkland Capital Group is an investment fund manager focused on commercial real estate. We provide bridge financing for the backbone of America, commercial property that is home to small and medium business. This includes multifamily financing that contributes to the rehabilitation of middle-income affordable housing. All of which makes a positive social and environmental impact. For investors, the Kirkland Income Fund provides high-yield fixed-income like returns with a focus on principal preservation.

Every three months, all team members take part in an online company review session. This review focuses on the company’s goals and discusses each person’s goals and successes in each work area. It also gives us a chance to assess our triumphs and find places where we can improve. Additionally, we brainstorm together on ways we can excel further.

The Role

We are hiring an Attorney (JD) to help us build the legal and operational backbone of a growing private real estate investment platform spanning both debt and equity.

This role is intentionally hands‑on at the start. You will personally own loan servicing and default management for an active commercial loan portfolio, including real foreclosure work. That execution is not busywork—it is how you earn deep context, credibility, and authority over the systems we are building.

At the same time, from day one, you will contribute to the Asset Management side of the business. As we expand into owning and operating real estate, this role plays a critical part in shaping how legal, risk, and operational decisions are made across both debt and equity investments.

Our long‑term roadmap is deliberate:

Phase 1 – Execution & Ground Truth
You personally run servicing and default management end‑to‑end. You help document, refine, and pressure‑test our SOPs and risk controls while contributing legal and risk analysis to asset management decisions.

Phase 2 – System Building & Leverage
As processes mature, portions of servicing work are automated or delegated to a servicing assistant. Your role shifts toward designing systems, supervising execution, and owning higher‑level legal and risk decisions across the portfolio.

Phase 3 – Strategic Operator & Advisor
You become a strategic partner to leadership, advising across both the debt and equity sides of the business—helping guide structure, risk posture, and decision‑making as the platform scales.

This is not a traditional legal role. We are not looking for someone who wants to research in isolation or draft endlessly without ownership. We are looking for an execution‑oriented attorney who believes that legal work should be embedded directly in operations and asset performance, not siloed or reactive.

What will you do?

You will operate as an execution-driven owner of loan servicing, default management, and legal risk—while contributing from the beginning to the Asset Management side of the business.

Loan Servicing, Workouts & Default Management (Initial Primary Focus)

  • Personally own the borrower lifecycle end-to-end, including maturity outreach, extensions, modifications, late payments, NSF handling, defaults, and foreclosure coordination.
  • Lead real foreclosure and workout execution across multiple jurisdictions by working directly with specialized local counsel—owning timelines, strategy, and outcomes rather than outsourcing responsibility.
  • Draft and negotiate loan modification, forbearance, and settlement agreements with a focus on protecting capital and preserving optionality.
  • Make time-bound decisions with imperfect information, escalating risks early and clearly when tradeoffs are required.
  • Maintain accurate, real-time loan records, logs, and documentation across systems—treating documentation as a core risk control, not administrative work.
  • Identify recurring failure points in servicing and default workflows and convert them into documented SOPs, controls, and automation opportunities.

Asset Management Legal & Risk (From Day One)

  • Contribute legal and risk analysis to Asset Management decisions as the firm expands into owning and operating real estate assets.
  • Advise on legal, structural, and risk considerations related to renovations, leasing, operating agreements, and asset-level decision-making.
  • Support workouts that transition from debt to equity, including REO strategy and disposition vs. hold decisions.
  • Help shape how legal review, risk controls, and documentation standards are embedded into Asset Management operations—not bolted on after the fact.

System Building & Leverage (As You Earn It)

  • Help design and refine the servicing operating system so execution can be automated or delegated over time to a servicing assistant.
  • Shift progressively from hands-on execution toward system design, supervision, and higher-level decision ownership as leverage is built, acting as a thought partner to leadership on legal, risk, and operational strategy across both debt and equity portfolios.

This role is designed for someone who is comfortable starting deep in execution, understands that ownership precedes leverage, and wants to grow into a strategic seat by building systems that scale.

About You

We are looking for someone who unequivocally says "yes, that's me" to the descriptions below.

  • Juris Doctor (JD) required; active bar license preferred but not required (you will coordinate with outside counsel for jurisdiction-specific practice).
  • 3+ years in creditor-side foreclosure/workouts (commercial preferred), or equivalent hands-on experience managing multi-state foreclosure timelines with outside counsel across jurisdictions.
  • You are living in a North American aligned time zone.
  • You have excellent written and spoken English communication ability.
  • You are execution‑oriented and comfortable with frequent reprioritization, driving work to completion in a dynamic environment.
  • You communicate clearly and early—listening first, escalating when something is slipping, and never going silent when overwhelmed or uncertain.
  • You are adept at taking ownership of results, effectively managing outside counsel while retaining accountability.
  • You treat documentation, logs, and updates as core risk controls, not administrative work.
  • You take ambiguous, messy workflows and turn them into clear SOPs, checklists, and controls that other people can run.
  • You are an active problem‑solver with a strong learning orientation—able to respond to new questions quickly and resourceful in finding answers.
  • You can zoom in (foreclosure details) and zoom out (portfolio-level risk tradeoffs) without losing rigor.
  • You are interested in expanding into Asset Management legal/risk work (e.g., REO strategy, hold/sell decisions, leasing/renovations/operations) and partnering with operators and investors.
  • Demonstrated success in high-discipline environments (e.g., military, competitive athletics, high-intensity operations) is a plus.

Benefits
