Claims Counsel

In this role, you will take ownership of complex contract surety claims from initial investigation through resolution. You will evaluate performance and payment bond exposures, develop and execute claim strategies, and determine appropriate performance options to protect the company’s financial interests. Your work will involve deep analysis of contracts and project circumstances, hands-on coordination with principals, obligees, subcontractors, suppliers, consultants, and attorneys, and clear communication with internal partners.

As a legal advisor to underwriting and business teams, you will provide guidance on contract language, risk assessment, and mitigation strategies. You will prepare internal analyses and reporting for large or high-exposure claims, establish and manage appropriate reserves, and proactively identify opportunities to reduce loss. When disputes arise, you will lead negotiations, represent the company in mediations and arbitrations, and help shape litigation strategies that align with both legal and business objectives.

Drafting and negotiating agreements will be a regular part of your work, including takeover agreements, completion agreements, subcontractor ratification agreements, and other documents necessary to discharge bond obligations. You will also pursue salvage opportunities through indemnification and subrogation when appropriate, while carefully managing loss adjustment expenses through effective oversight of outside counsel, consultants, and accountants.

This opportunity is well suited for an attorney with a Juris Doctor (JD) degree from an accredited law school and an active license in good standing. Candidates should bring at least five (5) years of related insurance or surety claims experience. Prior experience handling complex contract surety claims is strongly preferred.

Success in this role requires sound judgment, strong analytical and negotiation skills, and the ability to manage multiple complex matters while navigating challenging situations with professionalism and clarity.
