Job Title: Commercial Contract Attorney
About the opportunity: The Commercial Contract Attorney position is a motivated, practical, and solution-oriented professional to review, draft and negotiate a variety of commercial agreements. The position reports directly to the President of PHCNA and dotted line to PHC Group Legal Department. The position is relied on to provide expert, timely legal services with some direction and guidance.
Location: This is a hybrid role, that reports into the Wood Dale, IL site.
What you will be doing:
Identify needs and support for continuous improvement of contract processes, policies and templates, support with the implementation of new policies and templates.
Draft and manage contracts, contract templates, and keep compliant with rules, regulations, codes, and policies, assist with the implementation of reporting requirements.
Protect and mitigate company risks that may arise from contractual commitments.
Ability to evaluate business cases, identify legal risks and effectively communicate risks with senior executives.
Manage contractual timelines and discussions regarding renewals, amendments, change orders.
Draft and finalize policies and procedures to align with U.S. legal requirements and support the communication of new policies and procedures to employees and managers.
Assist the business and members of global legal team in identifying and prioritizing US compliance risks on an ongoing basis and develop and implement monitoring plans and solutions to avoid or manage compliance risks.
Execute monitoring according to monitoring plans; Use monitoring findings to identify compliance risk trends; Oversee required remediation or corrective actions.
Possesses collaborative approach with various departments, provide legal advice to leadership, and help set up systems to streamline the contracting process.
Support the conducting of internal audits and assist in the implementation of corrective actions required by audit findings.
Review promotional materials involving the marketing and sales of Biomedical products and services.
Manage such other legal matters as may be assigned by the incumbent’s direct supervisor and/or the head of the legal department.
Performs other duties as assigned.
What you need for success:
Minimum 5 years of experience as contract professional or attorney.
Minimum 2 years of experience at a healthcare company or institution, or directly involved in the representation of medical device industry clients.
Licensed Attorney
Strong knowledge of medical device industry laws, guidelines, and codes is preferred, but not required.
Knowledge of FDA and FTC regulations is preferred, but not required.
The hiring range for this position is: $125,000 - 170,000, plus individuals may be eligible for an annual discretionary bonus. Actual compensation within the range will be dependent upon the individual's skills, experience, qualifications and location, and applicable employment laws.
