Job Overview
This position is responsible for successfully managing and overseeing the Mercedes-Benz USA litigation portfolio related to consumer finance litigation. This position may also be responsible for other litigation, risk management, or legal topics which impact Mercedes-Benz USA.
Responsibilities
-
Advising MBUSA on various laws impacting captive finance companies, including the Fair Credit Reporting Act, Equal Credit Opportunity Act, Telephone Consumer Protection Act, UDAAP laws, state debt collection and unfair business practice laws.

Retaining, overseeing and directing outside legal counsel nationwide (setting effective case strategy and case specific budgets, negotiating cost-effective fee agreements)

Conducting early case assessments and investigations into factual allegations of a lawsuit and providing outside counsel initial factual findings and initial legal assessment

Performing substantive legal work related to litigation and pre-litigation disputes, such as reviewing and editing answers, legal briefs and discovery responses, preparing witnesses for depositions/hearings/trials/arbitrations, negotiating settlements/preparing settlement agreements.

Managing class action, product liability, warranty, consumer litigation or other related activities as required.

Keeping legal management and business teams apprised of significant lawsuits and legal issues; work with business teams on root cause analysis of lawsuits

Managing legal holds and working with IT to ensure that documents/data are preserved for litigation

Supervising paralegal(s) who support litigation-related work.

Working with legal and business teams on how to reduce risk

Performing legal research as necessary and documenting findings via formal memorandum

Monitoring industry news to enhance the company’s compliance with consumer financial protection laws

Providing reporting on litigation to business units and leaderships teams

Working with team members, customers, dealers and service providers to de-escalate and resolve disputes
Qualifikationen
Qualifications
Knowledge and Skills:

Requirements:
-
Licensed as an attorney to practice law, with a minimum of 5 years as a practicing lawyer with law firm or in-house litigation experience.
-
Litigation experience should include engaging in all aspects of written discovery, taking and defending depositions, motion practice, as well as trial or arbitration experience, and experience working directly with clients.

Excellent professional and academic credentials.

Have excellent legal research and writing skills

Ability to successfully manage a high-volume of cases.

Experience with consumer finance laws – including debt collection, credit reporting and the TCPA.

A willingness to learn about company products, activities, structure, and third-party business relationships.

Strong attention to detail with above-average multi-tasking skills and the ability to adapt quickly to situations that require immediate transition.

Willingness to travel to represent the company’s interests for litigation activities and other business activities.

Ability to work in person on a “hybrid” or other schedule as determined by corporate policy or business needs at Mercedes-Benz USA’s Sandy Springs, GA office.

Ability to leverage technology, software, and databases to manage workflow efficiently and collaborate with other stakeholders.
