Court Clerk/Magistrate

Department: Municipal Court

Reports to: Assistant City Clerk

GENERAL DESCRIPTION:

The purpose of this position is to exercise authority as assigned by law to issue warrants, accept pleas, receive and record fines, provide clerical support to the court, and perform other duties as mandated by applicable local, state, and federal law.

ESSENTIAL DUTIES:

  • Acts as a liaison between the municipal court and the public by receiving, recording, and responding to citizens’ complaints, requests, and questions either by phone or in-person by providing general information on court cases (e.g., court dates, fees, fines, and court procedures), retrieving and reviewing case files and other records, assisting individuals with completing required forms, or taking payments for court fees and fines in order to provide adequate services to and meet the needs of the public.
  • Conducts hearings within prescribed time limits by evaluating complaints, recording and reviewing witness testimony, reviewing police reports, and reading depositions in order to determine probable cause, issue arrest warrants, accept pleas, and set bail.
  • Enters citations issued by law enforcement personnel and ordinance violations from building inspectors; determines fines based on standards established by state and/or local laws; receives money assessed for bonds, fines and forfeitures; records money received to the correct case number; issues receipts on fines received; enters payments into computer.
  • Issues subpoenas to victims, complainants or witnesses for trials on cases.
  • Prepares court dockets for use in courtroom proceedings; prepares appeal cases for Circuit Court and Court of Criminal Appeals; ensures documentation is complete and accurate in accordance with all applicable laws, codes, and guidelines.
  • Assists the Judge and Prosecutor before, during, and after court as needed; prepares discovery requests from the attorney.
  • Receives, records, reviews, composes, and approves legal records, documents, forms and requests; records, processes and forwards records to appropriate departments and agencies; ensures documents are filed and maintained for ease of retrieval and utilization by the court.
  • Balances monies received against receipts daily and monthly; researches any errors detected and corrects accordingly.
  • Performs the suspension of Driver Licenses in accordance with state law; issues notice to the Department of Public Safety in cases of suspension or reinstatement.
  • Monitors alternative sentencing programs; collects payments; communicates program participation between community service agencies and the judge; collects and/or completes monthly compliance reports.
  • Maintains a comprehensive, current knowledge and awareness of applicable laws/regulations; attends professional workshops and training.
  • Maintains departmental files both in paper and electronic format; retrieves information and files as requested.
  • Conducts background checks; contacts other courts to request dispositions of prior offenses.
  • Performs a variety of administrative and clerical tasks as needed.
  • Communicates with supervisor, co-workers, law enforcement, attorneys, judges, other departments, city officials, citizens, local/state/federal agencies, outside agencies, and other individuals as needed to coordinate work activities, review status of work, exchange information, or resolve problems.

MINIMUM QUALIFICATIONS:

High School Diploma or GED; Associate’s Degree and clerical experience in a legal setting is preferred. Must obtain and maintain certification as a Magistrate from the Alabama Administrative Office of the Courts (AOC) in the manner and within the time prescribed by AOC. Must enroll in a magistrates orientation and certification program approved by AOC within six months of employment.

ESSENTIAL PHYSICAL REQUIREMENTS:

The physical activities required for this position involve:
Sitting, standing, walking, reaching, stooping, crouching, kneeling, climbing, talking and hearing.

This position requires lifting:
Up to 25 pounds occasionally.
