The Office of the General Counsel of the Legislative Counsel Bureau (LCB) is seeking a diverse pool of qualified applicants for the position of Deputy General Counsel within the Legal Division. The LCB is a nonpartisan, legislative service agency that provides professional, technical and administrative support to the Nevada Legislature, which convenes biennially in odd-numbered years for 120-day sessions and for rare special sessions during the interim periods. The Deputy General Counsel oversees a wide array of legal duties for the Legislative Branch, including the negotiation, drafting and management of government contracts; representation in litigation before federal and state courts and administrative agencies; advising on governmental ethics, public meetings, legislative records, lobbying laws and legislative privileges and immunities; and oversight of compliance with employment laws and LCB rules and policies. This is a full-timeposition located in Carson City, Nevada.

Position Description: Under the direction and supervision of the General Counsel and other senior attorneys within the Office of the General Counsel, the Deputy General Counsel will provide legal advice and counsel regarding matters affecting the Legislative Department and its members, officers, and employees, including performing legal research, preparing written legal opinions, assisting in litigation and ensuring LCB compliance with state and federal law. Responsibilities of the Deputy General Counsel may include, without limitation:

· Drafting, negotiating, reviewing and managing contracts, MOUs and interlocal agreements for the LCB;

· Maintaining and updating contract templates and playbooks to ensure consistency with legal requirements and LCB needs;

· Overseeing the contract lifecycle management process, ensuring proper routing, tracking and documentation consistent with LCB policies and statutory requirements;

· Advising on contract compliance, risk mitigation, intellectual property and legal matters related to contract enforcement;

· Conducting comprehensive legal research and analysis on complex constitutional, statutory, regulatory and administrative issues;

· Drafting written legal opinions and memoranda, including providing advice on existing law, proposed legislation, policies and LCB operations;

· Reviewing, drafting and revising internal policies, rules and procedures;

· Assisting the General Counsel in representing the Legislative Department in litigation and administrative actions before federal and state court and regulatory bodies;

· Preparing pleadings, briefs, discovery responses and other litigation documents under the direction of the General Counsel;

· Supporting the General Counsel in initiating, defending or intervening in actions involving the Legislative Department as required;

· Advising on matters involving governmental ethics, public meetings, legislative records, lobbying laws, legislative privileges and immunities and related areas of public-sector law;

· Providing legal guidance and training to legislative staff on compliance with state and federal law, including governmental ethics and internal rules and policies;

· Assisting the Employment Law Unit with employment-related matters, including administrative inquiries and claims, internal investigations, disciplinary actions and participation in administrative hearings; and

  • Performing other duties as assigned.

Minimum Qualifications: The Deputy General Counsel will be selected with special preference given to the candidate’s training, experience and aptitude in the field of law. A qualified applicant must have: (1) a juris doctor (JD) degree from an ABA accredited law school; and (2) active Nevada bar membership in good standing. Experience in public-sector legal practice or governmental contracting is preferred.

· Strong legal research, reasoning and analytical abilities, including the capacity to synthesize facts and law efficiently;

· Proficiency in interpreting constitutional provisions, statutes, regulations, policies, and case law and applying them to complex factual scenarios;

· The ability to quickly learn new areas of law, adapt to changing priorities, and work effectively in a dynamic environment;

· The ability to manage multiple assignments, shifting priorities and tight deadlines;

· Sound professional judgment and the ability to work both independently and collaboratively in a high-volume environment;

· The ability to safeguard confidential, privileged and sensitive information in accordance with legal and ethical requirements;

· Uncompromising integrity and adherence to the highest standards of ethical and professional conduct; and

· The ability to develop and maintain effective working relationships inside and outside the LCB.

Salary: The annual salary for this position is based upon a Grade 43, which has a salary range of $91,496 to $137,954 under the employee/employer paid retirement option. An employer-paid contribution plan is also available with a reduced salary in lieu of an employee contribution. Actual starting salary will be based on experience.

Working Conditions: The work is performed in a typical office environment. Significant overtime is required during legislative sessions and may also be required during certain other periods as necessary to meet the demands of the Legislature. When overtime is worked, the Deputy General Counsel may earn compensatory time that can be taken at a later date or be paid for the overtime, consistent with the LCB Rules and Policies and subject to budgetary limits. Occasional in-state travel may be required, which may occur outside normal business hours. Rare out-of-state travel may also be required.
