GENERAL DESCRIPTION OF THE ROLE:
The Deputy Prosecuting Attorney assists the Bear Lake County Prosecuting Attorney in performing the statutory and constitutional functions of the Prosecuting Attorney’s Office. While this role may occasionally assist in criminal matters – including the prosecution of misdemeanor and felony cases in both Magistrate and District Court – the Deputy Prosecuting Attorney selected to fill this position will be heavily relied upon in representing the State of Idaho in quasi-criminal and civil actions. These responsibilities shall include representing the State of Idaho in Child Protective Act Proceedings, Juvenile Court, and Mental Health Commitment Proceedings within Bear Lake County as well as attending the meetings of both the Board of County Commissioners and Planning & Zoning Commission. The Deputy Prosecutor’s duties will include providing legal advice to elected officials and other county employees on a variety of matters including employment law, contract interpretation, federal regulations, planning and zoning, and other civil areas of the law. The Deputy Prosecuting Attorney works under the direction of the Bear Lake County Prosecuting Attorney but has considerable latitude to exercise independent judgment and initiative. The principal duties of the Deputy Prosecuting Attorney are performed in the office, the courtroom, and during meetings set by other county officials.
SUPERVISION RECEIVED:
The Deputy Prosecutor will work under the general supervision of the Bear Lake County Prosecuting Attorney. Immediate supervision and coordination with the Bear Lake County Prosecuting Attorney may ensue before filing petitions to initiate child protection, juvenile, or commitment cases, but the Deputy Prosecutor will continue their work in proceedings subsequent to the filing determination with lesser (general to limited) supervision from the Bear Lake County Prosecuting Attorney. The Deputy Prosecutor may be afforded latitude in giving routine advice to the Board of County Commissioners and other public officers of the County, but any determination that may have a significant or long-term impact on official dealings of the County must first receive the advice and consent of the Bear Lake Prosecuting Attorney before being formally issued by the Deputy Prosecutor.
PRIMARY DUTIES AND RESPONSIBILITIES:
· Attend and provide counsel at the Board of County Commissioners Meetings on the second and fourth Monday of each month in Paris, Bear Lake County, Idaho.
· Attend and provide counsel at the Planning & Zoning Commission Meeting on the third Wednesday of each month.
· Promptly provide legal advice to, and respond to questions from, county officials and county employees in a wide variety of subjects, as requested.
· File petitions, conduct trials, and provide prosecution at all other necessary hearings for Juvenile Court on the third Friday of each month.
· File petitions, conduct trials, and provide prosecution at all other necessary hearings for Child Protective Act Proceedings once each month.
· File petitions, conduct trials, and provide prosecution at all other necessary hearings for Mental Commitment Proceedings as they arise.
· Interact, mediate, and negotiate with opposing counsel, judges, office staff, and other agencies.
· Review and prepare official documents of a legal nature, including contracts, agreements, resolutions, and ordinances, as requested.
· Perform a variety of legal research functions.
SECONDARY DUTIES AND RESPONSIBILITIES:
· Serve as back up to the Bear Lake County Prosecuting Attorney for felony criminal matters on the first and third Thursday of each month in District Court and for misdemeanor criminal matters on the second and fourth Wednesday of each month in Magistrate Court when scheduling conflicts may arise.
· Provide assistance to the Bear Lake County Prosecuting Attorney in high-level or otherwise legally complex criminal cases and/or civil matters at various points in legal proceedings, including trial.
· Perform other duties as assigned by the Bear Lake County Prosecuting Attorney.
MINIMUM QUALIFICATIONS:
The requirements listed below outline the minimum education, knowledge, and ability required to satisfactorily perform the essential duties required for this position. An applicant must meet each of the following requirements in order for their application to be considered.
1. Graduation from a law school accredited by the American Bar Association with a Juris Doctor Degree;
2. License to practice law in the State of Idaho;
3. Three (3) or more years of experience as an attorney practicing within county government in the State of Idaho, having gained experience and knowledge of:
o Constitutional law, legal, court, and judicial procedures, rules, terminology, methods, documents, practices, and objectives;
o County, state, and federal laws, statutes, ordinances, and codes applicable to the aforementioned primary duties and responsibilities;
o State and federal laws affecting county government; and
o Legal research methods; and
4. Ability to appear without assistance and to attend to required duties in Paris, Bear Lake County, Idaho on the following days of each month:
o Second (2nd) and Fourth (4th) Monday – Board of County Commissioners Meeting;
o Third (3rd) Wednesday – Planning & Zoning Commission Meeting; and
o Third (3rd) Friday – Juvenile Court; and
5. Ability to appear without assistance and to attend to required duties in Paris, Bear Lake County, Idaho when Child Protective Act Proceedings and Mental Commitment Proceedings are scheduled by the court.
