Head of Contracts & Claims

JOB PURPOSE:

The Head of Contracts & Claims will oversee all contractual and claims-related activities across construction and landscaping projects. This senior leadership role is responsible for ensuring compliance with contract terms, managing disputes, and safeguarding the company's commercial interests throughout the project lifecycle.


Key Responsibilities:


Contract Management:

  • Lead the drafting, review, and negotiation of contracts, subcontracts, and agreements, ensuring alignment with company policies and legal requirements.
  • Administer post-award contracts, ensuring compliance with terms and conditions.
  • Oversee the preparation and evaluation of tender documents, ensuring accuracy and completeness.

Claims Management:

  • Identify, assess, and manage contractual claims, variations, and disputes.
  • Prepare and submit claims for extensions of time, cost variations, and other entitlements.
  • Represent the company in negotiations, mediations, and arbitrations related to claims and disputes.

Risk Management:

  • Conduct risk assessments to identify potential contractual and commercial risks.
  • Develop and implement strategies to mitigate identified risks.
  • Advise senior management on risk exposure and recommend corrective actions.

Team Leadership:

  • Lead and mentor the contracts and claims team, fostering a culture of continuous improvement.
  • Provide training and development opportunities to enhance team capabilities.
  • Ensure effective communication and collaboration within the team and with other departments.


Stakeholder Engagement:

  • Liaise with clients, subcontractors, consultants, and legal advisors on contractual matters.
  • Maintain positive relationships with stakeholders to facilitate smooth project execution.
  • Represent the company in meetings and discussions related to contracts and claims.

Reporting & Compliance:

  • Prepare regular reports on contract performance, claims status, and risk assessments for senior management.
  • Ensure compliance with local laws, industry standards, and company policies.
  • Maintain accurate and organized records of all contractual documents and correspondence.

EXPERIENCE & QUALIFICATION:

  • Bachelor's degree in Civil Engineering, Construction Management, Law, or a related field. A Master's degree is advantageous.
  • Minimum of 15 years of experience in contracts and claims management within the construction or landscaping industry.
  • At least 5 years in a senior leadership role overseeing contracts and claims functions.

Skills & Competencies:

  • In-depth understanding of construction contracts, including FIDIC, JCT, and local UAE standards.
  • Familiarity with construction processes, project management, and legal aspects of contracts.
  • Strong ability to assess complex contractual issues and develop effective solutions.
  • Experience in preparing and evaluating claims, variations, and disputes.
  • Excellent negotiation skills with the ability to manage conflicts and reach amicable resolutions.
  • Strong written and verbal communication skills for effective stakeholder engagement.
  • Proven ability to lead and develop a team, fostering a collaborative and high-performance culture.
  • Ability to make strategic decisions and provide guidance to senior management.
