Health Insurance Exchange Attorney
Anticipated Starting Salary Range: $90,000 - $150,000
Starting Salary Commensurate with Qualifications and Experience

The State Corporation Commission’s (“SCC” or “Commission”) Office of General Counsel (“OGC”) seeks a staff attorney to join its Financial Services section. This position primarily will provide legal counsel and support to the SCC’s Health Benefit Exchange (HBE) Division. As part of this role, the position will work with HBE Division staff concerning all matters within the division's regulatory jurisdiction and consult with other attorneys in OGC. The attorney will support the entirety of the HBE Division and its functions. The candidate selected for this position will provide legal advice on issues concerning Virginia's Exchange, including federal and state law and regulations, matters related to insurance and health plans, enrollment, contracting and procurement, and operation of the Exchange. The attorney will advise the HBE Division on legislative matters, including state legislation affecting the Exchange as well as proposed federal legislation. The attorney will appear as needed before the Commission as staff counsel in formal proceedings concerning HBE Division matters and any related hearings. The selected attorney also will provide support for the Bureau of Insurance's Life & Health Section and provide assistance to other OGC attorneys assigned to that section. Due to the overlap of subject matter expertise between the HBE Division and the Life & Health Section of the Bureau of Insurance (particularly regarding health insurance plans and related regulations under both Virginia and federal law), the position will work with and support both divisions on matters of shared interest.

Major tasks that the attorney will be asked to perform include: (i) providing oral and written legal advice as assigned, in accordance with all professional standards of attorneys; (ii) preparing draft Commission orders, opinions, regulations, administrative procedures, memoranda and correspondence as assigned; (iii) reviewing contracts and agreements related to the HBE Division and providing guidance; (iv) conducting formal proceedings before the Commission as staff counsel; and (v) performing related work as requested.
