HUMAN RESOURCES COMPLIANCE OFFICER

SALARY: $172,138.64 - $193,948.80 Annually (Range 246)

LENGTH OF SERVICE: 227 Days per Year/12 Months

POSITION DESCRIPTION

Under the direction of the Assistant Superintendent, Human Resources, the Human Resources Compliance Officer shall manage all aspects of Title IX compliance, Uniform Complaint Procedures (UCP), personnel complaints, formal complaint procedures, and informal complaint resolution. This position will conduct complex and sensitive investigations and provide regular trainings for San Bernardino County Superintendent of Schools (SBCSS) leadership on compliance, complaint procedures, and investigation procedures.

The Human Resources Compliance Officer shall act as a resource and liaison among SBCSS staff, parents, and community members to resolve a variety of personnel issues. This position is responsible for responding to complaints, preparing comprehensive reports, recommendations, and coordinating appropriate interim and remedial measures. This position also conducts research and analysis to inform policies, procedures, and training materials, and recommends effective language, strategies, and practices to promote equity and compliance.

ESSENTIAL JOB FUNCTIONS

· Manages all aspects of Title IX compliance, including personnel complaints, formal and informal resolution processes, and the intake, review, and processing of Title IX complaints in alignment with federal regulations and county policy;

· Conducts investigations and resolves compliance processes including, but not limited to, Title IX, UCP, employee-to-employee complaints, non-discrimination in employment, and harassment complaints;

· Interprets and applies provisions of the California Education Code, relevant federal and state laws, county policies and procedures, and collective bargaining agreements;

· Researches, compiles, and analyzes data for county, state, and federal reports;

· Conducts complex, sensitive investigations involving employee misconduct, including egregious misconduct, and student-safety allegations;

· Reviews and synthesizes information related to complaints; conducts interviews with all involved parties; compiles and analyzes relevant data; prepares written findings documenting outcomes for appropriate stakeholders; and assists in drafting disciplinary documents, including termination statements of charges;

· Develops, implements, and evaluates compliance training;

· Assists with Public Records Act requests and grievances;

· Develops and recommends policies and procedures for review;

· Responds on behalf of San Bernardino County Superintendent of Schools to all outside agency complaints alleging the county has discriminated against individual(s) within a protected class;

· Maintains current knowledge of federal, state, and local laws, county regulations, policies, and procedures, court decisions, and other litigation relevant to all areas of personnel and employee relations;

· Provides consultation to branches/departments and school sites related to areas of responsibility;

· Provides technical assistance to sites;

· Attends and participates in legal seminars, professional support organization meetings, professional development trainings and/or conferences, meetings, and workshops as assigned by the Assistant Superintendent, Human Resources;

· Assists with conducting presentations, trainings, events, and/or workshops countywide;

· Prepares a variety of forms and reports;

· Supervises staff as applicable;

· Performs other related duties as assigned.

JOB REQUIREMENTS

Experience in personnel related investigations including Title IX and UCP; conducting training and/or workshops; working with state and Federal laws, Education Code, and policies and procedures;

Skill in interpretation of laws, rules, policies and procedures; reviewing and evaluating operational processes; problem solving; investigations; writing investigation reports; utilizing various forms of technology;

Knowledge of current laws and regulations pertaining to human resources and employer/employee relations; Title IX, Uniform Complaint Procedures, and California Education Code; conducting investigations and recommending a plan of action; problem solving and conflict resolution techniques; basic research and statistical methods; mediation, grievance, and legal issues regarding collective bargaining and complaint resolution techniques;

Ability to train and supervise staff; analyze, interpret, and apply laws and regulations; manage department priorities, processes, and procedures; exercise excellent mediation, analytical, problem-solving, and organization skills with attention to detail; work independently; prioritize and manage deadlines; manage multiple tasks; work with a variety of individuals and groups; communicate efficiently orally and in writing; travel to various locations using a personal vehicle;

Physical Abilities include sitting, standing, and walking for extended periods, reaching, fine manual dexterity, pushing and pulling, talking/hearing, near and far visual acuity, depth perception, and field of vision.

MINIMUM QUALIFICATIONS

· Bachelor’s Degree;

· Five (5) years of professional level experience working in Human Resources in a school district, university, or County Office of Education;

· Four (4) years experience preparing and managing complex data software platforms and reports;

· Four (4) years experience conducting training and/or workshops;

· Two (2) years experience related to personnel investigations;

· Possession of a high school diploma (or its equivalency) or higher or possession of a GED;

· Possession of a valid Driver’s License and use of personal transportation required. (SBCSS vehicle not provided).

DESIRED QUALIFICATIONS

· Experience in a supervisory or leading position;

· Master’s Degree.
