General Description

The AHT Legal Assistant performs complex legal assistant work and administrative support duties designed to assist the AHT prosecutors with caseload management of suspected Human Trafficking cases. Work involves reviewing complaints and inspection reports, drafting legal documents, scheduling hearings, preparing witnesses, and organizing evidence for presentation in the State Office of Administrative Hearings (SOAH), including Emergency Order hearings. The AHT legal team may also occasionally testify at SOAH. Works under limited supervision with moderate latitude for the use of initiative and independent judgment concerning priorities, methods, and procedures to accomplish assigned duties. The AHT Legal Assistant reports to the Chief Prosecutor and supports the Anti-Human Trafficking Division Director and AHT prosecutors.

Essential Job Functions

  • Reviews investigative and inspection reports to ascertain that all necessary evidence has been obtained and makes recommendations to the AHT prosecutors regarding resolution of primarily AHT cases.
  • Drafts appropriate legal documents and correspondence, including but not limited to notices of alleged violation, notices of hearing, settlement agreements, letters of proposed license denial, motions, agreed orders, exceptions to proposals for decision, warning letters, and case closing letters.
  • Maintains an accurate tickler system for notices of alleged violation, case files, and other time-sensitive documents. Records relevant information in the case management system.
  • Responds to inquiries about AHT enforcement cases, internal and external to the agency, and inquiries regarding AHT’s enforcement procedures and policies. Responds to such inquiries daily both orally and in writing.
  • Assists the AHT attorneys in preparing for hearings, including docketing cases for administrative hearings, including Emergency Order hearings; scheduling witnesses and helping prepare them for testifying; organizing documentary evidence; and preparing exhibit lists, trial notebooks, and other tools used by the AHT attorneys.
  • Maintains an accurate schedule of informal conferences and administrative hearings, and prompts attorneys and investigators as needed for trial preparation or case settlement.
  • Attends administrative hearings and Commission meetings with the AHT attorneys, assisting as needed.
  • Assists the AHT attorneys in negotiating settlements of AHT enforcement cases.
  • Assists the AHT attorneys in managing a high-volume caseload that are primarily Human Trafficking related cases but may also include cases under all statutes administered by TDLR.
  • Conducts Internet research as needed to identify and obtain background information about individuals, business entities, properties, and events.
  • Assists the General Counsel’s Office on open records requests including gathering and compiling responsive documents and information.
  • Performs duties in accordance with division policies and procedures set forth by the Chief Prosecutor and the Director.

Required and Preferred Qualifications

  • Graduation from a standard senior high school or GED equivalent is required.
  • Five (5) years of experience performing legal assistant work is required. (Thirty (30) semester hours of college coursework in a field related to law or investigations may be substituted for one year of the required legal assistant work experience.
  • Willingness to work irregular hours, evenings, weekends, and holidays as workload requires.
  • Willingness to travel on occasion up to 5% for work-related purposes as required.
  • Graduation from an accredited four-year college or university or certification as a legal assistant or paralegal is preferred.
  • Three (3) years of related experience in a governmental regulatory program or law enforcement agency is preferred.
  • Experience drafting and interpreting legal documents, reviewing cases according to statute and rule requirements; preparing witnesses and exhibits for trial is preferred.
  • Experience performing legal research and conducting investigative work utilizing the Internet and other resources is preferred.
  • Experience investigating information involving respondents, individuals, businesses, and properties is preferred.
  • Experience preparing reports, designing charts, and assisting in the preparation of manuals, guidelines, policies, and procedures is preferred.
  • Experience in using an electronic case management system like LegalFiles is preferred.
  • Experience with Human Trafficking or Sexual Assault cases is preferred.
  • Fluency in Mandarin or Vietnamese is preferred.
  • Experience with personal computers to include experience with Microsoft Word, Excel, PowerPoint, Internet, and email is preferred.

Knowledge, Skills, and Abilities

  • Knowledge of legal practices and terminology, and of basic legal concepts.
  • Knowledge of the Public Information Act, including gathering and compiling responsive documents and information.
  • Knowledge of basic investigative methods, rules of evidence, and agency policies and procedures relevant to investigations and enforcement; and of administrative law proceedings and the associated legal documents.
  • Skill in the use of computers and applicable software, including Word, Excel, PowerPoint, and Outlook; and in the use of a computer to produce complex legal documents, correspondence, statistical reports, and other complex documents.
  • Skill in the use of standard office equipment.
  • Skill in conducting Internet research; in the use of case management systems and electronic databases; and in the operation of office equipment.
  • Excellent communication skills in the context of telephone contacts, in-person contacts, and testifying in court.
  • Excellent writing skills, including proficiency in drafting legal documents and basic business correspondence using proper spelling, punctuation, sentence structure, and grammar.
  • Ability to use a computer to produce legal documents, correspondence, presentations, statistical reports, and other complex documents.
  • Ability to plan and manage multiple tasks or courses of action simultaneously and respond effectively to rapidly changing priorities in a highly visible setting.
  • Ability to establish and maintain effective working relationships and provide professional, friendly, and caring customer service to all customers.

Physical and Mental Requirements

  • Must be able to sit or stand for extended periods of time, work well in stressful situations under strict deadlines, and operate standard office equipment and computer software
