1. Legal Documentation & Drafting
- Drafting, reviewing, and vetting sale deeds, agreements to sell, MOUs, lease deeds, JV agreements, development agreements, and POAs.
- Preparing RERA agreements, builder-buyer agreements, and allotment letters.
- Ensuring all contracts are legally sound and enforceable.
- Knowledge of the Gujarati language and Gujarati typing is mandatory.
2. Title Due Diligence & Property Verification
- Conducting title search and verifying property ownership history.
- Checking 7/12 extracts & No 6 Entries, NA permissions, title clearance certificates, search reports.
- Ensuring land is free from disputes, claims, or encumbrances.
3. Regulatory Compliance
- Ensuring compliance with:
- RERA Act
- Stamp Duty & Registration Act
- Land Revenue Code
- Town Planning Laws
- Environment & Construction Laws
- Monitoring approvals from Municipal Corporations, Collector, Urban Development Authorities, and other regulatory bodies.
4. Litigation Management
- Handling any legal disputes related to:
- Land acquisition
- Customer complaints
- Vendor disputes
- Coordinating with external advocates and law firms.
- Drafting legal notices and replies.
5. RERA Compliance
- Assisting in project registration, quarterly updates, extensions, and documentation.
- Maintaining legal documents required for audits and inspections.
6. Risk Mitigation & Advisory
- Identifying legal risks in new projects, partnerships, or customer agreements.
- Advising management on land laws, compliance issues, and legal implications.
- Ensuring no project is launched without complete legal clearance.
7. Contract Management
- Drafting and reviewing contracts with:
- Vendors
- Contractors
- Channel Partners
- Consultants
- Investors
- Ensuring terms protect the company’s interest.
8. Customer Legal Support
- Handling customer agreement issues, cancellations, and refunds.
- Resolving disputes through legal channels where necessary.
9. Coordination With Other Departments
- Working closely with:
- Sales & CRM (documentation, customer agreements)
- Land Acquisition Team
- Finance & Accounts (stamp duty, taxation)
- Operations & Projects (approvals, permissions)
10. Document Registration
- Coordinating registration of property documents at Sub-Registrar offices.
- Ensuring correct stamp duty and registration fees are applied.
11. Record Management
- Maintaining soft and physical copies of:
- Agreements
- Permissions
- Licenses
- Registrations
- Case files
12. Policy & Legal Updates
- Monitoring changes in real estate laws, government policies, and court rulings.
- Updating management and teams accordingly.
Experience:
- 3+ years of relevant experience in Legal Department (experience in the real estate sector is a plus)
- LLB Degree Mandatory
