Job Description: Legal Head – Real Estate Position Overview
The Legal Head will lead and manage the legal function for the real estate business, ensuring compliance with applicable laws, mitigating legal risk, overseeing transactions, and providing strategic legal advice to senior management. This role requires strong expertise in property law, regulatory frameworks, contract negotiation, and dispute management.
Key Responsibilities1. Legal Strategy & Governance
- Develop and implement the legal strategy aligned with business objectives.
- Advise the Board and senior leadership on legal risks and opportunities.
- Ensure the business complies with relevant real estate, environmental, corporate, and commercial laws.
2. Property Due Diligence
- Oversee legal due diligence for land acquisitions, development projects, joint ventures, and leasing activities.
- Evaluate title reports, encumbrances, zoning regulations, permissions, and compliance requirements.
- Ensure clear and marketable titles for all acquisitions.
3. Contracts & Documentation
- Draft, review, and negotiate a wide range of real estate agreements including:
- Sale & purchase agreements
- Joint development agreements (JDA)
- Lease agreements
- Construction & vendor contracts
- MOUs, LOIs, NDAs, and service agreements
- Establish contract templates and ensure consistency across projects.
4. Regulatory & Compliance Management
- Liaise with government authorities for approvals, registrations, RERA compliance, and other statutory requirements.
- Monitor changes in real estate laws, corporate governance rules, and regulatory policies.
- Ensure all real estate projects adhere to local and national regulations.
5. Litigation & Dispute Resolution
- Manage and oversee real estate litigation, arbitration, and dispute resolution.
- Coordinate with external legal counsel and ensure optimal outcomes for the organization.
- Maintain updated records for all legal cases.
6. Risk Management
- Identify potential legal risks and develop mitigation strategies.
- Conduct internal audits and compliance reviews for real estate projects.
- Provide training to business teams on legal processes and policies.
7. Team Leadership
- Lead and mentor the in-house legal team.
- Collaborate with cross-functional departments including Finance, Projects, Sales, and Operations.
- Ensure efficient workflow, timely legal clearances, and high governance standards.
Qualifications & Experience
- LL.B./LL.M. from a recognized university.
- 10–15+ years of experience in real estate law or property-related legal practice.
- Strong understanding of land laws, RERA, contract laws, and regulatory frameworks.
- Proven experience in managing litigation, negotiations, and large-scale transactions.
- Excellent communication, analytical, and leadership skills.
