Eisenberg & Baum, LLP represents people in civil rights cases nationwide. Our attorneys have secured dozens of favorable jury verdicts, argued before the United States Supreme Court, and litigated precedent-setting cases in federal appellate courts across the country. Our work has been featured in The New York Times, The Wall Street Journal, and TIME.

We handle cases that matter, challenges to discriminatory licensing schemes, failures to provide ASL interpretation in healthcare and law enforcement settings, and employment discrimination under the ADA and Rehabilitation Act. If you want to do substantive federal litigation on issues of first impression, this is the place.

The Role We are seeking a Litigation Associate with exceptional writing ability. You will serve as a primary drafter for dispositive motions and appellate briefs, develop legal strategy on novel legal questions, and manage federal cases from complaint through resolution.

You will work directly with senior partners on high-stakes matters, including petitions for certiorari, circuit court appeals, and trials. We are looking for an attorney who views brief writing as a craft.

Responsibilities

  • Draft substantive filings, including complaints, motions for summary judgment, and appellate briefs in the United States Courts of Appeals.
  • Research circuit splits, issues of first impression, and developing doctrine under federal civil rights and constitutional law
  • Assist in preparing petitions for certiorari and amicus briefs.
  • Manage a docket of federal civil rights cases with an emphasis on building trial-ready records.

Qualifications

  • Top-Level Research & Writing Skills: We prioritize writing ability above all else. Candidates must be able to synthesize complex records into persuasive narratives.
  • J.D. from an accredited law school.
  • Active bar admission in New York (or eligibility to waive in).
  • Genuine interest in civil rights, disability law, or public interest work.

Preferred Experience

  • Federal Judicial Clerkship or Law Review Editorial Board experience is strongly preferred.
  • Familiarity with American Sign Language (ASL fluency is valued).

Why This Role

  • The work is real. Associates here draft substantive appellate briefs and motions. Your writing will go before Article III judges.
  • The issues are novel. We litigate questions that circuit courts haven't resolved—categorical exclusions from professional licensing, police department failures to provide interpreters, systemic barriers to healthcare access. This is law-development work.
  • The impact is tangible. Our cases change policies, open doors, and set precedents. You will see the direct effect of your work on clients' lives.

To Apply Please submit:

  • Resume.
  • Cover letter explaining your interest in disability rights litigation.
  • Strict Requirement: An unedited writing sample (preferably a dispositive motion or appellate brief). Please do not submit a heavily edited collaborative piece; we need to evaluate your raw analytical and writing skills.

Eisenberg & Baum, LLP is an equal opportunity employer. We celebrate diversity and are committed to creating an inclusive environment for all employees. We encourage applications from individuals of all backgrounds.
