SUMMARY
The Litigation Attorney – First-Party Property role provides legal advice, strategic guidance, and litigation representation for first-party homeowner property insurance claims. This role is responsible for managing all phases of claims litigation, from pre-suit evaluation through resolution, including discovery, depositions, motions practice, mediations, hearings, and trial preparation. The Litigation Attorney works closely with the Claims Department to assess coverage issues, develop litigation strategy, manage legal exposure, and ensure compliance with applicable laws and regulations.
ESSENTIAL DUTIES AND RESPONSIBILITIES
- Manage first-party homeowner property litigation through resolution, including coordination with claims personnel, depositions, mediations, hearings, and settlement negotiations.
- Independently prepare, review, and file pleadings, disclosures, motions, discovery, settlement evaluations, and other litigation-related documents in first-party property matters.
- Draft timely responses to Civil Remedy Notices regarding homeowner’s insurance claims.
- Provide legal guidance and strategic counsel to the Claims Department regarding coverage analysis, litigation risk, reserving considerations, and claim resolution strategy.
- Serve as a subject-matter resource on first-party property insurance law, advising internal teams on legal developments and best practices impacting claims operations.
- Identify, analyze, and communicate emerging legal, regulatory, and case law trends affecting homeowner property insurance and litigation exposure.
- Conduct legal research; gather and evaluate evidence; depose witnesses; prepare legal memoranda; and develop sound, business-focused litigation strategies.
- Review statutes, regulations, and judicial decisions to support compliance efforts and recommend updates to policy language, procedures, or litigation practices as appropriate.
- Maintain the highest standards of professionalism, ethics, and integrity in all interactions internally, and with policyholders, opposing counsel, vendors, and members of the judiciary.
- Perform other related duties as assigned.
QUALIFICATIONS
- Juris Doctor (JD) from an accredited law school.
- Active, good-standing membership with the Florida Bar.
- At least one (1) year of litigation experience, particularly involving Florida first-party homeowner property insurance claims; relevant experience is strongly preferred but not required for otherwise well-qualified candidates.
- Strong knowledge of homeowner’s insurance policies, Florida Rules of Civil Procedure, and first-party property law.
- Excellent written and verbal advocacy skills, with the ability to clearly communicate legal concepts to both legal and non-legal audiences.
- Ability to manage a caseload efficiently with appropriate guidance and increasing independence over time, while complying with internal litigation guidelines.
- Proficiency in Microsoft Office and online legal research tools (e.g., Westlaw and LexisNexis) preferred.
- Strong analytical, negotiation, and problem-solving skills.

WORK ENVIRONMENT
- Standard office environment may involve court appearances, travel to inspections, mediations or meetings.
- This is not a remote position. All new hires are expected to work in the office five (5) days per week.

Pay: $150,000.00 - $178,336.91 per year
