Associate Attorney - Real Estate Litigation & Bankruptcy
Boutique Real Estate Law Firm is seeking a highly motivated and experienced Associate Attorney* to join our dedicated Firm. We specialize in real estate matters, primarily focusing on wrongful foreclosure litigation, landlord/tenant disputes, and often times related bankruptcy proceedings.
Position Highlights
This role requires a skilled litigator with a strong courtroom presence. The ideal candidate will be prepared to take on active cases and manage a diverse docket.
Key Responsibilities
Trial and Litigation: Handle all phases of litigation, from initial pleading through discovery, motion practice, mediation, and trial(mostly bench and sometimes jury) in state and federal courts.
Wrongful Foreclosure: Represent homeowners in disputes against lenders, including actions for wrongful foreclosure, predatory lending, quiet title, and breach of contract. Must be familiar with some recent developments in Real Estate.
Bankruptcy Court Practice: Represent clients on issues such as automatic stay litigation, motions for relief, plan confirmation objections, and adversary proceedings (e.g., dischargeability and lien stripping).
Landlord/Tenant: Manage a caseload of both residential and commercial unlawful detainer actions, rent control disputes, and complex habitability litigation.
Client Management: Provide clear, strategic, and compassionate counsel to clients through stressful and often high-stakes legal processes.
Legal Research & Writing: Draft persuasive motions, detailed trial briefs, appellate documents, and legal memoranda.
Qualifications
Juris Doctor (J.D.) degree from an accredited law school.
Active membership, in good standing, with the California State Bar.
Minimum of 3-5 years of hands-on litigation experience is required.
Proven trial experience (first or second chair) in state or federal court.
Good understanding of California real estate law, particularly foreclosure and landlord/tenant statutes.
Exceptional written and oral communication, negotiation, and analytical skills.
Ability to work independently, manage multiple deadlines, and thrive in a fun and fast-paced boutique environment.
