Misdemeanor Court Compliance Officer

Under the supervision of the County Manager, the Misdemeanor Compliance Officer monitors offenders convicted of misdemeanors for sentencing compliance.


Responsibilities:

· Determine the extent to which referred defendants comply with their sentences for attending and completing court-ordered programs and treatments through professional interaction with Magistrate and District Courts, including but not limited to paying fines, fees, and restitution.

· Through telephone calls, virtual meetings, and office visits, encourage and motivate referred defendants to comply fully with sentences from the courts, including but not limited to the payment of fines, fees, and restitution.

· Remain objective and unbiased in all cases and interactions.

· Must know and maintain proper, professional courtroom decorum.

· Must dress professionally, in business attire, at all times.

· Must maintain and uphold the highest standards of ethics, integrity, and professionalism.

· Provide periodic defendant compliance and non-compliance reports to the courts, District Attorney’s Office, and defense attorneys.

· Receive and receipt compliance program costs and monthly fees from the defendant.

· Set up and maintain a community service program withing the county.

· Track defendants sentenced to the probation program.

· Make random visits to residences, places of employment, bars, and restaurants.

· Require and carry out periodic, random testing of the defendants for alcohol and drug compliance.

· Serves as the liaison between the courts and misdemeanors offenders.

· Will be required to appear in court to testify.

  • Works with Torrance County courts and the District Attorney’s Office, giving sentencing recommendations for probation violations for DWI and other misdemeanor offenders.
  • Alerts courts to misdemeanor offender non-compliant behaviors and files probation violation documentation.
  • Arranges and inputs misdemeanor offender information into a statewide client tracking system per the Department of Finance and Administration administrative guidelines.
  • Will be required to attend probation violation hearings.
  • Compiles information and assists with the production of program reports and grant applications.
  • Conducts bar checks monthly, documenting and submitting any violations to the Courts.
  • Maintains accurate records and files for the department and for grantor contract requirements.
  • Issues warrant requests and order to show cause requests.
  • Completes necessary administrative forms to ensure accurate and complete data collection.
  • Composes correspondence, reports, spreadsheets, and other program related documents.
  • Monitors use of ignition interlocks and treatment attendance.
  • Will be required to assist with and/or perform the duties of other departmental employees.

· May be required to work irregular hours, attend job related meetings, and perform all duties with minimal supervision.

· Respond to calls in the event of an emergency involving the Compliance Program and/or the DWI Program.

· Must be able to meet deadlines and work under pressure.

· May be required to attend out of town trainings and seminars.

· Complete annual requirements for continuing education.

· Refer clients to social resources in the community to aid in rehabilitation.

· Recommend changes and assist to develop, coordinate, modify, and implement methods, procedures, and policies involving the day-to-day functioning of the Misdemeanor Compliance Program (MCP).

· Work closely with other segments of the Local DWI Grant Program including the Screening,

Treatment, Teen Court, Coordination/Planning/Evaluation, and Prevention components of the

program as assigned.

· Follow the State of New Mexico Purchasing and Procurement laws, County Purchasing Policy, and grant agreements in making purchases, transferring, and deposing of assets.

· Other duties as assigned.

· Position may be partially grant funded.

· Ability to operate in a professional office environment.

· Ability to travel regularly within and without the community.
· Ability to work flexible hours, including evenings and weekends to accommodate awareness events and workshops and to respond to calls in the event of an emergency involving the DWI Program.
· Ability to work occasionally in outside weather conditions.
· Ability to stand and remain in a prone position during an emergency.
· Ability to sit up to eight hours per day with intermittent sitting, standing, and walking.

Minimum Education and Qualifications:

· High school diploma or GED certification required.

· Associates Degree and two (2) years of experience in judiciary, criminal justice, counseling, or another human services discipline.

· Or four (4) years of experience in judiciary, criminal justice, counseling, or another human services discipline.

· Two (2) years of Court experience.

· Must have the ability to operate a computer, its software and general office equipment.

· Valid New Mexico State Driver’s License. Must have a good driving record to be insurable for liability purposes.

· Proficient in the use of MS Office and financial management software.

· Knowledge of approved principles and practices of law enforcement and applicable laws and ordinances.

· Knowledge of investigative techniques and practices.

· Knowledge of courtroom decorum and etiquette.

· Ability to report and record, legally and accurately, observations and situations.

· Ability to maintain confidentiality.

· Must complete initial and periodic compliance officer training and pass the basic test within one (1) year of hire.

· Must complete training and maintain job knowledge related to search and seizure, condition of probation, authority, jurisdiction, interviewing, controlled substance, blood borne pathogens, universal precautions, first aid, use of force, officer safety, domestic violence.

· Must complete required FEMA training(s) as assigned to position.

· Must complete a Road Ready course within six (6) months of hire and must renew every two (2) years.
