DEFINITION:
Under the direction of the Tribal Executive Officer or designee, the Probation/Tribal Court Officer is responsible for probationary related duties for adult/juvenile offenders under the jurisdiction of the Walker River Paiute Tribe (WRPT) Tribal Court. The Probation/Tribal Court Officer will work to supervise/manage individuals placed on probation or parole, monitor probationary compliance with court orders, conditions of release, assisting the individual toward rehabilitation and other related probationary oversight duties.
In addition to the probation duties, this position is also responsible for security and maintaining order of WRPT Tribal Court. The Probation/Tribal Court Officer is responsible for providing courtroom safety and security of tribal court proceedings, preventing life-threating activities toward courtroom personnel, witnesses, visiting public as well as taking appropriate measures to protect WRPT Tribal Court property during Court proceedings. This position will also be responsible to issue service of Court Ordered legal documents, summons, subpoenas, conduct drug and alcohol testing, as well as conduct inmate transport to and from jail facilities for WRPT Tribal Court purposes.
DUTIES AND RESPONSIBILTIES:
- Manage and plan assigned adult and juvenile caseloads probation or parole offenders’ probation caseload; schedules appointments; prepares and maintains required case documentation and information pertinent to each individual probationer. Performs intake work for new probationers; discusses court ordered probationary sentence obligations; informs probationers of probation requirements, policies and procedures; responsible for counseling probationers in activities related to those requirements.
- Provides regular supervision of assigned probationers court ordered conditions and follows offender’s progress and/or violations of the terms and conditions of their probation or parole; establishes reporting schedule; meets with probationers to discuss progress with court orders; investigates alleged violations of probation; executes community service assignments and secures remedial action by court if necessary; executes warrants of arrest as necessary.
- Compiles and prepares required reports, maintains individual case files for probationers to ensure compliance with the conditions of probation. Conducts regular office as well as unannounced visits to the offenders’ home, school, or place of employment, including nighttime and weekend spot checks of probationer behavior.
- Responsible for conducting alcohol/drug testing, monitor employment history and performance, and meets regularly with the offender (weekly-monthly, depending on screening tool guidance).
- Appears and testifies in court regarding probationers’ compliance with court ordered probation obligations; make appropriate recommendations on sentencing and probation revocation dispositions.
- Prepares and submits required statistical reports to support monthly, quarterly and annual statistical and narrative reports.
- Establishes professional network relationships with other services providers, court personnel, law enforcement personnel, families, community groups and organizations; answers questions and responds to requests for information regarding policies, procedures and probation operations; files recommendations of release; revocation, non-compliance, modifications with Tribal Prosecutor and Court; collaborates with law enforcement personnel in monitoring of probationers and provides courtesy supervision for County, State and Federal probationers.
- Serve as a Process Server serving notices and/or summons, both civil and/or criminal, on persons as directed by the WRPT Tribal Court.
- Probation/Tribal Court Officer maintains the safety, security, neutrality, integrity and confidentiality of the court system and prevents potentially life-threatening activities directed toward judges, court personnel, jurors, witnesses, defendants, prisoners and the public; maintains order in the courtrooms. The Tribal Probation/Tribal Court Officer Acts as liaison between the judge, attorneys, courtroom staff and the public to ensure the orderly conduct of court business and is responsible for the overall security for the WRPT Tribal Court.
- This position transports detainees and assists transportation officers in moving detainees to and from the courtroom, holding cells and vehicles; conducts a safety search of courtroom prior to hearing; sets up courtroom for court operations and opens and locks secured areas and facilities; maintains order and security in the courtroom and waiting area during court sessions; maintain safety of court personnel including but not limited to Tribal judge, court staff, attorneys, jurors, witnesses and visitors in the courts; maintain safety of the court's property;.
- The above duties and responsibilities are not an all-inclusive list but rather a general representation of the duties and responsibilities associated with this position. The duties and responsibilities will be subject to change based on organizational needs, amendments to WRPT Tribal/Program goals and objectives and/or other duties deemed necessary by the supervisor, WRPT Tribal Court and/or WRPT Tribal Council.
KNOWLEDGE, SKILLS & ABILITY TO:
- Gather and analyze facts and draw logical and objective conclusions as well as communicate effectively both orally and in writing.
- Must understand, apply, and comply with WRPT Tribal Court policies and procedures, law and order codes and other applicable codes/regulations applicable to WRPT Tribe and WRPT Tribal Court rules of confidentiality.
- Ability to prepare legal documents for submission to the Court.
- Understand and comply with professional work standards with the ability to establish and maintain relationships with Court staff, superiors, Tribal officials, Tribal, state, Federal, and private agencies/service providers.
- Conduct drug and alcohol testing, including observing clients providing urine samples.
KNOWLEDGE, SKILLS & ABILITY TO cont.:
- Ability to maintain calm demeanor in all situations.
- Must be dependable, reliable and of high moral character. Individual must be able to work independently with little supervision as well as work effectively with WRPT Tribal Court, Administration, Law Enforcement and other outside agency personnel as required for program implementation.
- Must be willing to work on weekends and evenings, as directed or as necessary to fulfil job duties and program requirements.
- Must have knowledge and ability of use of standard and specified computer applications involving word processing, data entry and/or programs for report generation.
- Knowledge of Walker River Paiute Tribe, Great Basin Tribes and/or Native American communities, culture, history, and traditions preferred
MINIMUM QUALIFICATIONS:
- Must Possess a Current Nevada Category I and/or Category II POST Certification as required for Probation Officer’s educational requirements and Court Officer positions. Must always maintain active/current POST Certification and training requirements as a condition of employment which will be facilitated and maintained by the Walker River Tribal Law Enforcement Department.
- High school diploma/GED and experience in Law Enforcement or Public Safety OR any equivalent combination of education and experience
- Complete CPR, AED, & First Aid certification within six (6) months of hire date.
- Must successfully pass a Local, State and Federal background check.
- Must successfully pass pre-employment drug testing and submit to ongoing random testing as required by the WRPT Tribe.
- Must have and provide valid Nevada Driver’s License, provide a DMV driving report and be insurable under the Tribes insurance.
