Overall Responsibilities:

We are seeking a knowledgeable and detail-oriented Real Estate Attorney to join our in-house legal team. The ideal candidate will provide legal guidance on real estate transactions, loan originations, title and escrow matters, property rights, and regulatory compliance. This role is critical in ensuring all real estate-related legal documentation and procedures are compliant with applicable laws and industry standards.

Key Responsibilities:

  • Advise internal teams on legal matters involving real estate transactions, including loan closings, title issues, purchase/sale agreements, and deed preparation.
  • Review and draft mortgage-related documents, including promissory notes, security instruments, easements, and title commitments.
  • Identify and resolve issues related to title, liens, encroachments, zoning, and survey matters.
  • Support the loan origination and servicing teams with legal interpretation of real estate documentation.
  • Review and ensure compliance with federal, state, and local laws governing real estate transactions (e.g., RESPA, TILA, ECOA).
  • Coordinate with external title companies, escrow agents, and real estate attorneys in various jurisdictions.
  • Manage or assist with litigation related to real estate disputes, including title defects, boundary issues, or foreclosure actions.
  • Conduct legal research and provide training to internal departments on changes in real estate law and best practices.
  • Assist in regulatory audits and responses involving property and loan documentation.
  • Juris Doctor (JD) degree from an accredited law school.
  • 3+ years of experience practicing real estate law, preferably within the mortgage or financial services industry.
  • Strong understanding of residential and/or commercial real estate transactions and mortgage lending processes.
  • Experience resolving title issues, reviewing title insurance policies, and working with title companies.
  • Excellent drafting, negotiation, and communication skills.
  • Strong attention to detail and ability to manage multiple priorities.
  • Familiarity with real estate closing procedures and documentation standards.

Preferred Qualifications:

  • Experience working in-house at a mortgage lender, servicer, or title company.
  • Knowledge of investor guidelines (e.g., Fannie Mae, Freddie Mac, FHA, VA).
  • Experience with real estate litigation or foreclosure proceedings.
  • Familiarity with title curative processes and quiet title actions.
