<p>
This position is an attorney in the Enforcement Department. The Enforcement Department is one of seven departments in the Legal Services Division of the HHS Office of Chief Counsel. This attorney position in the Enforcement Department provides legal support related to childcare regulation (CCR). The subjects of the contested case hearings include enforcement actions against childcare permits and childcare administrator's licenses. The Attorney IV performs complex legal work involving enforcement actions by HHSC and is responsible for providing consultation services to HHSC clients and legal representation of HHSC in contested case proceedings. This position is also responsible for interpreting laws, regulations, and rules; preparing legal documents; rendering legal advice; consulting with attorneys; providing legal training and preparing cases for hearings.</p><br>

</p><p>The position serves as legal counsel for the Health and Human Services Commission and is responsible for representing HHSC in contested cases governed by the Administrative Procedure Act before the State Office of Administrative Hearings. The position is required to independently handle a busy docket of cases and should be experienced in and knowledgeable of litigation. The attorney advises program staff daily and helps them evaluate the legal sufficiency of proposed sanctions. The attorney also routinely provides training and consultation to HHSC staff regarding hearing processes. The attorney may serve on workgroups responsible for reviewing and drafting enforcement policies, procedures, and rules in order to effectively implement statutory obligations. The attorney works under limited direction with considerable latitude for the use of initiative and independent judgment.</p><br>

Essential Job Functions:</b></div>
<p>
This attorney position provides legal representation, consultation, and support to program areas across the Health and Human Services system. Attorneys are required to: consult with program staff on complex issues of law; review, develop, and conduct training; research and brief relevant legal issues; review policies, rules, regulations, and forms for compliance with legal standards; manage caseloads; prepare cases for trial; and represent HHSC at hearings. Attorneys are required to independently represent clients at hearings governed by the Administrative Procedures Act from docketing to completion, including: analyzing evidence and preparing case strategies; preparing and serving discovery requests; responding to discovery; preparing and responding to motions; identifying and preparing witnesses; conducting depositions; and representing the agency at hearing.</p>

Manages assigned cases, prepares cases for hearing, and resolves cases either through administrative hearing or settlement. 70%</p>

HRA is dedicated to fighting poverty and income inequality by providing New Yorkers in need with essential benefits such as Supplemental Nutrition Assistance, Cash Assistance, Emergency Assistance, Medicaid, Child Support, Fair Fares, as well as eviction prevention and rehousing assistance. DHS is committed to preventing and addressing homelessness in New York City by employing a variety of innovative strategies to help families and individuals successfully exit shelter and return to self-sufficiency as quickly as possible. DSS also includes administrative and supportive divisions such as the Office of Legal Affairs which includes the Fair Hearing Administration, among other litigation and counseling units.<br>

DSS&rsquo; Fair Hearing Administration is responsible for providing representation of the Agency at NYS Administrative Hearings in the following program areas for HRA: Cash Assistance (CA), Supplemental Nutrition Assistance Program (SNAP), Investigative Revenue and Enforcement Administration (IREA), HIV Aids Services Administration (HASA), Adult Protective Services, Homecare, and the Medical Assistance Program (MAP). The Fair Hearing Administration also represents the Agency in administrative hearings involving the Department of Homeless Services as well as HRA administered shelters for DV survivors.<br>

The Intentional Program Violation and District Attorney Referral Unit provides litigation services and legal counsel to the Commissioner, Chief Accountability Officer/Bureau of Fraud Investigation and Accountability, and executive management, as well as counsel to program on matters relating to fraud, in accordance with Federal, State and City laws and regulations.

Under the general direction of the Assistant General Counsel, with latitude for independent judgment and initiative, the Senior Attorney position will prosecute or defend civil legal actions in court or before administrative bodies or prepare and review legal documents on behalf of the Commissioner. This supervisory position is distinct from the other Agency Attorney positions since this position involves appearing in front of the appropriate administrative or judiciary body to litigate the interest of the agency pertaining to intentional program violations of any value or complexity, including those based on fraud, conspiracy, or collusion to obtain public assistance, SNAP, health coverage, or services to which the applicant or recertifying participant and/or their household members are not eligible for.<br>

The Office of the General Counsel / Fair Hearing Administration is requesting to recruit for one (1) Agency Attorney III to function as a Senior Attorney who will:<br>

<ul><li>Provide legal representation of the Commissioner of the Department of Social Services in administrative hearings and state courts on Intentional Program Violation litigation matters including but not limited to Administrative Disqualification Hearings and Article 78 actions by appearing in front of the appropriate administrative or judiciary body to litigate the interests of the agency in regards to intentional program violations of any value or complexity, including those based on fraud, conspiracy, or collusion.

<ul><li>Supervise legal staff by developing appropriate litigation strategies or by taking charge of the advocacy of particularly complex legal issues, managing time and leave and providing feedback on case management.

<ul><li>Draft and edit legal papers and gather evidence. Conduct legal research; conduct investigations and interview witnesses; prepare written motions, objections and rebuttals and other legal memoranda. Prepare and/or review the evidence packet for sufficiency in establishing clear and convincing evidence of intentional program violation(s).</li></ul><br>
<ul><li>Lead the preparation and presentation of cases to an outside prosecutorial agency where the anticipated top charge is a class A felony or lower

Performs moderately complex to highly complex legal work in the prosecution of enforcement cases at the State Office of Administrative Hearings (SOAH), and at Informal Settlement Conferences (ISC). Develops prosecution strategy for complex cases and negotiate agreed settlement orders. Files discovery and takes and defends depositions in contested case hearings. Drafts briefs and closing arguments in contested case hearings. Substantively, case work covers medical care issues related to the practice of medicine as well as professional boundaries and medical ethics. Works closely with expert witnesses with knowledge of medicine and ethical and professionalism issues. Works under general direction from the Director of Litigation and the Supervising/Lead Attorney, with extensive latitude for the use of initiative and independent judgement. Work involves litigation practice with legal writing and knowledge of the Medical Practice Act, the Administrative Practice Act, Texas Rules of Evidence, Texas Rules of Civil Procedures, and other applicable statutes and administrative rules.</div><div></div><h1 class="jobSectionHeader"><b><br>
PRINCIPAL</b><b> </b><b>JOB</b><b> </b><b>DUTIES AND RESPONSIBILITIES</b></h1><p>
60% Prosecutes enforcement cases at ISC involving licensees of the agency. ISC prosecution includes preparation of packets, presentation at hearings and the development of agreed orders. Coordinates with legal assistants, paralegals, nurse investigators, and other agency staff as needed to prepare document exhibits and evidence for case prosecution, in an effective and efficient manner. Work with expert witnesses and other professionals regarding medical issues and practice. Reviews and approvals all work prepared by support staff. Negotiates and drafts agreed orders that accurately reflect the decision of ISC panelist and clearly describes any limitations on practices responsibilities and actions required of the licensee.</p><p>
30% Prosecutes contested cases at SOAH involving licensees of the agency. Drafts and files pleadings and other documentation or correspondence related to contested case proceedings at SOAH to include formal Complaints/Petitions, pre-trial motions, case briefs, closing arguments, and Board orders. Represent the agency in all phases of contested case prosecution, including motions and pre-trial hearings. Oversees case development including conducting all phases of discovery and depositions of witnesses including experts. Perform legal research. Develop settlement options based on progress of case. Represent board at mediation. Finalize Agreed Order and agency documentation for consideration by Board within agency time schedules.</p><p>
5% Represent agency as prosecutor at Temporary Suspensions/Restriction Hearings. Prepares Order of Temporary Suspension/Restriction.</p><p>

<p><b>GS-12 Qualifications:</b> Assignments require the first professional law degree (LL.B. or J.D.) and active membership in the bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. In addition, one of the following requirements must be satisfied:<br>
a. Two years of professional legal experience at or equivalent to the GS-11 level.<br>
b. The second professional law degree (LL.M.) plus 1 year of professional legal experience at or equivalent to the GS-11 level.<br>
2. An attorney without experience may, in unusual cases, be employed at the GS-12 or equivalent level provided the individual has advanced educational attainments substantially beyond those required for work at the GS-11 or equivalent level, and his or her education clearly indicates ability to perform work of the type to be assigned; for example, education that included courses directly pertinent to the work of the agency. The essential point in such cases is to ensure that the individual's education has enabled him or her to step into complex legal work characteristic of the GS-12 or equivalent level, and to operate with the degree of independence and responsibility typical of that level.<br>

<b>GS-13 Qualifications: </b>Assignments require the first professional law degree (LL.B. or J.D.) and active membership in the bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. In addition, the attorney shall have professional legal experience in excess of 2 years that is commensurate with the duties and responsibilities of the position.<br>

This announcement is being used to fill positions with an entry grade of GS-12, or GS-13 with a full performance level of GS-13. The minimum salary for grade GS-12 is $89,447, the maximum salary is $116,286. The minimum salary for grade GS-13 is $106,365, the maximum salary is $138,276.<br>
