Attorney General Andrea Joy Campbell is looking for an experienced and highly motivated attorney to join her Antitrust Division as an Assistant Attorney General. The Attorney General&rsquo;s Antitrust Division protects the people, state agencies, and businesses of Massachusetts from anticompetitive practices and helps maintain and encourage a competitive and vibrant economy through fair and effective enforcement of the antitrust laws. The Antitrust Division investigates and challenges anticompetitive mergers, price-fixing agreements, and other illegal practices by companies, both local and national, that harm Massachusetts consumers and important state interests. Recent antitrust cases or matters brought by the Attorney General have involved, among other areas, airlines, online platforms/services, health care, communications, and pharmaceuticals.
Primary Duties: The Assistant Attorney General will represent the Commonwealth of Massachusetts in investigations and litigation before state and federal courts and will be responsible for handling a substantial number of matters involving the enforcement of state and federal antitrust laws. Cases will cover a broad range of industries and will often pose complex and cutting-edge legal and economic issues. In addition to handling their own cases, the Assistant Attorney General will work with other attorneys, including, in some cases, attorneys from other states across the country and attorneys with the United States Department of Justice and the Federal Trade Commission. The Assistant Attorney General may be involved in policy development, including drafting or reviewing proposed legislation.
Position Type: Full-Time/Exempt. Our current hybrid model includes some remote workdays for most positions.
Salary: $87,500-$130,595, commensurate with JD year.

Duties and Responsibilities
 
 
1. Commercial Litigation Management - Provide subject area legal advice to the business to manage litigation, work with business leaders to define risks and benefits of litigation strategy to develop the appropriate strategy for the business, and collaborate with business leaders to develop solutions and strategies that effectively manage risk while delivering business strategies and initiatives. 
<ul><li>
Manages a docket of commercial litigation and regulatory investigations/matters. Matters frequently include real estate disputes, commercial disputes, supply chain disputes, customer disputes, antitrust matters, collection matters, and various regulatory matters.
</li><li>Engage and manage outside counsel as needed.
</li><li>Provide legal strategy, risk analysis and resolution, policy review and updates, and legal advice to senior executives regarding litigation, business, and regulatory matters affecting business transactions and operations.
</li><li>Manage subpoenas and requests for information, and support ediscovery productions.</li></ul> 
2. Regulatory &amp; Compliance Legal Services - Provide general business &amp; regulatory advice to the companies of ADUSA. 
<ul><li>
Provide advice in connection with federal and state regulations and industry requirements as it relates to business operations and programs (i.e. labeling, pricing, banking, antitrust, FDA, OSHA, EPA/RCRA, ADA etc.).</li><li>
Engage and manage outside counsel as needed
</li><li>Provide strategic advise and counsel to management teams on business terms, legal implication and risk and liability analyses.
</li><li>Management of commercial disputes, government and NGO inquiries, and conduct internal Investigation, as appropriate.
</li><li>Support contracts team by offering litigation and regulatory advice on legal terms of contracts.
</li><li>Provide advertising and marketing support, including promotional program review, private label product support, trademark clearance, protection and maintenance, advertising law compliance.
</li><li>Support Health &amp; Sustainability teams with regulatory matters, compliance activities, and strategic advice</li><li>
Review various communications, including press releases, for release to the public
</li></ul> 
3. Training and Compliance - Provide communication and training on evolving legal issues and requirements 
<ul><li>
Proactively monitor relevant legal developments; regulatory, industry and business trends; and industry topics.
</li><li>Promote communication and awareness of legal developments, compliance issues and requirements, and best practices.</li><li>
Conduct training for regulatory matters as needed (e.g. antitrust compliance training for merchandising and related departments; payment card industry requirements; insurance requirements).
</li><li>Draft and continually update training materials and processes.</li></ul> 
4. Other responsibilities 
<ul><li>
Provide support to other practice groups in the Legal Department (Employment, Labor &amp; Benefits; Commercial, Real Estate, &amp; Strategic Transactions) as needed, to manage demand, build experience across the business, and develop attorneys.
</li><li>Provide support to cross-functional legal projects</li><li>
Provide input on proposed legislation, potential impacts, and implementation.</li></ul>
Qualifications

4+ years relevant experience practicing law

ME/NC/PA/SC Salary Range: $108,880 - $163,320
 
 
IL/MA/MD/NY Salary Range: $125,200 - $187,800
