</p><p>The Attorney General&rsquo;s Office is looking for a highly motivated Assistant Attorney General of integrity and commitment to public service to serve as a prosecutor in the White Collar &amp; Public Integrity Division of the Criminal Bureau.</p><p></p><p><br>
This Assistant Attorney General will be responsible for handling a broad range of criminal cases, spanning financial crime and public corruption offenses. Financial crime includes fiduciary embezzlement by professionals, complex financial frauds, and tax fraud schemes. Public corruption includes a broad array of schemes involving public officials, public institutions, and public funds. The Criminal Bureau is staffed by a group of experienced prosecutors who partner with financial investigators, Massachusetts State Police troopers assigned to the Attorney General&rsquo;s Office, and local, state, and federal investigative and enforcement agencies.</p><p></p><p>
</p><p>Primary Duties: The Assistant Attorney General will assume an existing caseload of substantive prosecutions and investigations, as well as responsibility for handling new assignments that include initial review and screening of allegations, formal grand jury investigations, and prosecutions up to and including trial. Assistant Attorneys General in the White Collar &amp; Public Integrity Division are charged with leading and coordinating the efforts of a prosecutorial team that typically includes a financial investigator, a state trooper, a victim/witness advocate, and support staff. Additional functions may include but are not limited to: (a) conducting joint investigations with other federal, state, and local referral agencies, prosecutorial organizations, and/or law enforcement agencies; (b) aiding the investigative and prosecutorial efforts of others within the Division; and (c) providing leadership and oversight of other team members&rsquo; contributions to case prosecutions.</p><p></p><p>

<p>Assistant Attorney General-Appellate - (25142816)<br/></p><p>Division Overview:<br/></p><p>The State&rsquo;s Attorney&rsquo;s Office in the Montana Department of Justice is dedicated to ensuring justice and upholding the rule of law on behalf of the people of Montana. The office includes the Solicitor General&rsquo;s Office, Criminal Prosecution and Appellate Services, Civil Services and Consumer Protection. The functions within the office include defense of Montana&rsquo;s laws as passed by the Legislature, constitutional challenges, determining legal sufficiency of ballot initiatives, prosecution of criminals, handling all phases of litigation from district court proceedings through appeal, and complex litigation of antitrust matters.<br/></p><p>Job Overview:<br/></p><p>The Appellate Services Bureau represents the State of Montana in criminal cases that are appealed to the Montana Supreme Court. Appellate Services also handles appeals in dependency and neglect cases resulting in termination of parental rights and appeals in involuntary commitment proceedings. Assistant Attorneys General in Appellate Services are required to handle issues of statutory interpretation and constitutional analysis that have statewide significance. This requires the ability to meticulously review lower court records and transcripts, conduct legal research, and write persuasive briefs advocating for the State&rsquo;s position. Appellate Services&rsquo; Attorneys are also responsible for conducting oral arguments in the Montana Supreme Court when the Court orders a case to be argued<br/></p><p>In addition, Appellate Services handles complex federal habeas corpus cases in the federal district court and the Ninth Circuit Court of Appeals. Federal habeas cases sometimes require depositions and evidentiary hearings. Federal habeas cases may involve an oral argument in the Ninth Circuit.<br/></p><p>Attorneys within Appellate Services must have the skills to manage competing deadlines and work independently on their cases. Appellate attorneys collaborate with colleagues and with prosecutors around the State to determine the best strategy to advance the goals of the criminal justice system.<br/></p><p>Minimum Qualifications:<br/></p><p>Juris Doctor Degree.<br/>At least two years of specialized law and litigation experience.<br/>Admission to and maintenance of licensure from the State Bar of Montana.<br/>If licensed in another state, must be able to become licensed to practice law in Montana within a reasonable time. Individuals with 5 years of practice in another state in good standing are eligible to be admitted on motion. The Special Prosecutions Division is responsible for prosecuting complex and specialized criminal cases throughout New Mexico. The Division specializes in handling cases related to internet crimes against children, child exploitation, violent crimes, fraud, and government accountability. The Special Prosecutions Division provides assistance and trial support to local prosecutors and law enforcement, and provides training for federal, state, and local agencies. In addition, the Division performs prosecutorial reviews of officer involved incidents.

<br>Why does the job exist?
<br><br>
Attorneys in the Special Prosecution Division establish a standard of excellence in the prosecution of various crimes throughout the State of New Mexico. Attorneys handle these matters from the intake/charging phase all the way through trial. Attorneys within the division carry a manageable caseload that allows time for collaboration with other attorneys in the division, consultation with experts, and trial preparation using expert jury consultants.

Key responsibilities are to prosecute criminal cases from screening to final disposition. This includes recommending charging decisions, motions practice, criminal litigation and trial. Prosecuting attorneys are expected to collaborate with law enforcement agencies throughout the state as well as Department of Justice Special Agents. They are expected to travel as needed within the state for pretrial interviews, courtroom appearances and other matters. Prosecuting attorneys also have the opportunity to give and participate in specialized trainings related to criminal prosecution.

<br>Minimum Qualification

Juris Doctorate degree from an accredited school of law and two (2) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Must possess and maintain a current Defensive Driving Course Certificate from the State of New Mexico or must pass and receive Defensive Driving Course Certification as a condition of continued employment as some statewide travel maybe required.
