Job Description
 
The United States Attorney's Office for the District of Minnesota is accepting applications for AUSA openings in our Civil Division.
 
The Civil Division handles a wide variety of civil cases, including healthcare and procurement fraud, civil rights enforcement, constitutional challenges to statutes and regulations, environmental defense and enforcement, financial litigation, bankruptcy, asset forfeiture, immigration, and the defense of employment discrimination and tort claims.
 
AUSAs in the Civil Division are responsible for representing the federal government and its agencies and employees in civil litigation in the district. These AUSAs conduct pre-trial investigations and handle all aspects of civil litigation, including taking and defending depositions, propounding and answering discovery, engaging in motions practice, trying cases, negotiating settlements, drafting appellate briefs, and arguing cases before appellate court judges. AUSAs are expected to work independently and in teams with other AUSAs and federal government agencies.
 
The attorney selected to fill the civil vacancy will engage in a broad civil, federal litigation practice across many of the different subject matters described above in the District of Minnesota. AUSAs in the civil division manage a high-volume docket of affirmative and/or defensive cases, depending on the needs of the office, as well as the interests and experience of the particular AUSA. AUSAs will work with a broad spectrum of federal agencies, representing the interests of the United States in federal court. For many matters, AUSAs will also have the opportunity to work closely with many different divisions within the Department of Justice. Preferred Qualifications:

Job Description
 
Responsibilities will include objecting to bankruptcy plans proposed under chapter 11 and 13 of the Bankruptcy Code, reviewing (and opposing where necessary) proposed asset sales in bankruptcy, prosecuting motions to dismiss or convert bankruptcy cases from one chapter to another, protecting federal agencies' interest in cash collateral, obtaining determinations regarding the discharge ability of federal debts, and responding to objections to federal agencies' claims.
 
The position will also require defending the following types of lawsuits filed in Bankruptcy Court: (i) complaints to determine the discharge ability of federal debts, (ii) complaints to determine the extent, validity or priority of federal liens, and (iii) complaints to recover pre-bankruptcy payments to federal agencies.
 
Typical agencies represented include the Department of Treasury (including the IRS), the Department of Health and Human Services, the Small Business Administration, the Department of Veterans Affairs, the Department of Agriculture, the Department of Defense, the Department of Housing and Urban Development, and the Department of Education.
 
The candidate may be assigned other financial and debt collection litigation matters, according to office needs. Candidate must work independently and serve as effective and dedicated advocates for the government's interest, timely and efficiently pursue the just resolution of their assigned cases and make sound and legally supportable decisions. The candidate must possess the foresight and organizational and legal skills needed to manage a diverse caseload that involves both a high volume and complex cases. They must be able to identify the relevant legal and factual issues in their assigned cases, and to develop and implement effective strategies for all proceedings in those cases, including motions practice, discovery, alternative dispute resolution, trial, and appeal. They must be able to work well with their colleagues, supervisors, support staff, and witnesses. Job Description
 
AUSAs in the Civil Division work on a diverse range of defensive matters, including personal injury, medical malpractice, wrongful death, and other tort actions; employment discrimination actions; immigration matters; prisoner litigation; and actions challenging governmental policies, activities, and decisions. Civil AUSAs also handle affirmative investigations and cases involving fraud, immigration, forfeiture, and other areas. Day to day responsibilities include working with client agencies and investigators to gather information, conducting legal research, engaging in motion practice, preparing and answering discovery requests, defending and taking depositions, retaining and working with experts, negotiating settlements, trying cases, and briefing and arguing appeals.
 
The successful candidate will be primarily responsible for representing the United States of America, Federal agencies, and Federal employees in a wide variety of civil defensive litigation. The caseload may include defending immigration cases; employment discrimination cases; medical malpractice, premises liability, and other tort litigation; statutory and constitutional challenges to government programs; Administrative Procedure Act cases; FOIA and Privacy Act cases; and Bivens civil rights suits.
 
Although this position is primarily focused on civil defensive litigation, the successful candidate may also be assigned affirmative civil cases. This area includes False Claims Act actions involving healthcare fraud and fraud on pandemic-era programs.

The annual base salary range for the selected Assistant United States Attorney is $63,163 to $123,868, plus benefits. The 17.06% locality applies to Springfield, Peoria, and Urbana. The 18.93% locality applies to Moline.
