</li><li>At least three (3) years of full-time legal experience, preferably including complex civil litigation and/or criminal justice experience, such as litigation or advocacy involving law enforcement practices or experience as a prosecutor or criminal defense attorney.
</li><li>Experience working directly with or on behalf of members of the public, especially historically marginalized communities.
</li><li>Demonstrated commitment to ensuring the trust and confidence of communities in law enforcement agencies and ensuring accountability when law enforcement officers commit misconduct.

The Civil Rights Section of the Litigation Division of the Office of the Utah Attorney General seeks an attorney to represent state employees, state agencies, school districts and universities in civil rights litigation.<br>
<br>
The Civil Rights Section defends civil rights litigation against state entities and employees. These claims are primarily brought in federal court pursuant to 42 U.S.C. &sect; 1983 alleging violations of rights under the United States Constitution but may include pendant state-law tort claims and state constitutional claims. The successful applicant should anticipate litigating Eighth Amendment claims alleging inadequate medical care against corrections officers; Fourth Amendment claims alleging excessive force and illegal search and seizure against Utah Highway Patrol Troopers; and First Amendment and Fourteenth Amendment claims against other state agencies and their employees. Attorneys in the Civil Rights Section also defend Universities and school districts in lawsuits alleging Title VI, Title IX, and ADA violations.<br>
<br>
 This position requires excellent written and oral advocacy skills. This position also requires experience and ability to immediately assume primary responsibility for litigating cases with minimal supervision. At least five years civil litigation experience. Knowledge of federal and state civil litigation, the Utah Governmental Immunity Act and the substantive and procedural elements of litigating &sect; 1983 claims in federal court is preferred.<br>
<br>
Membership in good standing in the Utah State Bar, or qualification for practice pending admission to the Utah Bar under Utah Supreme Court Rule of Professional Practice14-809, is required. Some travel is required as incumbents will need to represent their clients in civil litigation and other legal proceedings throughout the state.</p></div><p></p>

The Civil Rights Division (CRT or Division) of the Department of Justice (DOJ or Department), created by the enactment of the Civil Rights Act of 1957, works to uphold the civil and constitutional rights of all Americans, particularly some of the most vulnerable members of our society. The Division enforces federal statutes prohibiting discrimination on the basis of race, color, sex, disability, religion, familial status, national origin, and citizenship status.

Job Description
<br><br>
<b>Duties of a Deputy Director, include:</b><br>
Supervising outreach, case screening and development, investigations, settlement negotiations and enforcement, and complex litigation, including discovery, motion practice, injunction hearings, trials, and post-judgment proceedings;
<br>Reviewing, editing, and approving substantive written work product;
<br>Collaborating with the management team to implement and refine enforcement strategies and priorities;
<br>Coordinating with federal agencies and other DOJ components to ensure effective information sharing and case referrals; and
<br>Performing administrative and leadership responsibilities, including evaluating attorneys and staff and managing special projects assigned by leadership.

The Second Amendment Section is charged with enforcing the Second Amendment rights of law-abiding American citizens. The Section investigates alleged patterns or practices of Second Amendment infringement by law enforcement, and files statements of interest when cases in litigation affect the interests of the United States.
<br><br>
The Appellate Section works with the Division's trial sections to represent the United States in civil rights cases in the federal courts of appeals. Many of the Section's cases are appeals from district court judgments in cases originally handled by the Division's trial sections.
<br><br>
The Criminal Section, one of the oldest of the Civil Rights Division's sections, enforces federal criminal laws that date to the post-Civil War Reconstruction Era.
<br><br>
The Disability Rights Section works to achieve equal opportunity for people with disabilities by implementing the Americans with Disabilities Act (ADA). DRS has a central role in enforcement, regulation, and technical assistance under the ADA and Section 504 of the Rehabilitation Act (Section 504).
<br><br>
The Educational Opportunities Section enforces Titles IV and VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, the ADA, Section 504, and the Equal Educational Opportunities Act of 1974.
<br><br>
The Employment Litigation Section enforces Title VII of the Civil Rights Act of 1964 and other federal laws prohibiting discriminatory employment practices against state and local government employers, and the Uniformed Services Employment and Reemployment Rights Act of 1994 against non-federal employers.
<br><br>
The Housing and Civil Enforcement Section protects some of the most fundamental rights of individuals, including the rights to access housing free from discrimination, to access credit on an equal basis, to patronize places of business that provide public accommodations, and to practice one's faith free from discrimination.
<br><br>
The Immigrant and Employee Rights Section enforces the anti-discrimination provision (§ 274B) of the Immigration and Nationality Act (INA), 8 U.S.C. § 1324b, which prohibits citizenship status discrimination in hiring, firing, or recruitment or referral for a fee; national origin discrimination in hiring, firing, or recruitment or referral for a fee; unfair documentary practices during the employment eligibility verification process; and retaliation or intimidation.

The Special Litigation Section protects the civil rights of people in state or local institutions; of individuals with disabilities to receive services in community settings; of people who interact with state or local law enforcement; of youth involved in the juvenile justice system; of people to have safe access to places of religious worship and reproductive health clinics; and of people to practice their religion while confined to state and local institutions.

The Voting Section enforces the civil provisions of federal statutes designed to safeguard the right to vote of all American citizens, including the Voting Rights Act, Uniformed and Overseas Citizens Absentee Voting Act, National Voter Registration Act, Help America Vote Act, and Civil Rights Acts.

Qualifications

<b>Required Qualifications:</b><br>
Applicants must possess a J.D. from an American Bar Association accredited law school, be an active member of the bar in good standing (any jurisdiction) and possess a minimum of six (6) years of post-professional law degree experience. Applicants also must have strong, demonstrated qualifications in the following areas: academic achievement; substantive knowledge and expertise in the laws, rules and regulations applicable to the work of the Section; written and oral communication skills; the ability to analyze complex issues; skill and experience working collaboratively and productively with others; organizational skills; professional judgment; initiative; and the ability to excel in a fast-paced, demanding environment.  POSITION: Crime Victims Legal Assistance Project (CVLAP) is seeking a Staff Attorney focused on serving Native American survivors of domestic violence in Northern Michigan with family law matters. This Staff Attorney will be responsible for working with clients (ranging from advice to full litigation) with civil cases in both State and Tribal Court. Although their work will be fully remote, this Attorney will be responsible for serving clients located primarily in Northern Michigan (but not in the Upper Peninsula) so applications residing in Northern Michigan are given preference. This grant funded contract position expires October 2026. When fully staffed, the CVLAP Tribal Survivor Project (TSP) team is made up of a Supervising Attorney, 2 Staff Attorneys and a part-time Legal Assistant. This position is part of a joint project with Uniting Three Fires Against Violence, which is a Statewide Tribal domestic violence and sexual assault Coalition serving the Tribes located in Michigan. The Tribal Survivor Project staff are also part of the larger CVLAP program, which is connected with civil legal aid attorneys across the state that specialize in providing legal assistance in cases involving, domestic violence, stalking, sexual assault and elder abuse.  DESCRIPTION OF PROGRAM: CVLAP is a statewide program with staff throughout Michigan, in collaboration with Legal Services of Eastern Michigan, Legal Aid of Western Michigan, Legal Services of South Central Michigan, Legal Services of Northern Michigan, Michigan Immigrant Rights Center, and Lakeshore Legal Aid. CVLAP provides outreach and a wide range of legal representation and advocacy to victims of crime, primarily domestic violence and elder abuse survivors under the federal Victims of Crime Act (VOCA) and the Violence Against Women&rsquo;s Act (VAWA).

 CVLAP is part of Michigan Statewide Advocacy Services (MSAS), a non-profit law firm providing free legal services to older adults and people with low income through several statewide programs. MSAS is administered by the Michigan Advocacy Program (MAP), which provides access to the justice system for those who need it the most through civil legal aid offices and statewide advocacy programs. MAP&rsquo;s mission is to advance the safety, independence, and economic stability of those most affected by poverty, racism, and other structurally oppressive systems by increasing access to justice and working for systemic solutions.  BENEFITS: This is a full-time position with a salary starting at $60,000 depending on experience. MAP offers a generous benefits package including life, short- and long-term disability, health, vision, dental and flexible spending accounts. If staff do not require health benefits, they have the option to take an annual $1,500 payout in addition to the base salary paid over the course of the year. MAP also has a generous leave policy allowing staff to accrue 3 weeks paid vacation the first year and 15 paid holidays, as well as a 401K retirement plan including employer match for eligible staff after 6 months of employment.
