The Deputy Prosecutor III provides professional legal services, which include prosecuting felony, misdemeanor, and/or juvenile cases, making charging decisions, negotiating case settlements, and assisting the County Prosecutor with other legal and administrative work necessary to achieve the objectives of the office. Assignments may be made to prosecute specific types of cases such as major crimes, complex litigation, serious felony, and civil cases. The position provides general direction to assigned legal and other assistant support positions but is not a supervisory position. Essential Duties and Responsibilities
The Deputy Prosecutor III assumes daily responsibility and performs tasks in the following areas:

Investigates, prepares, and manages felony, misdemeanor, and/or juvenile cases for trial, including but not limited to: reviewing charges and evidence, conducting legal research, interviewing affected parties, preparing required legal and court documents, preparing, and arguing briefs, and attending court proceedings,</li><li>
May be assigned specific types of cases such as major crimes, complex litigation, serious felony, and civil cases, or other complex specializations,</li><li>

Job Description: 
The incumbent is under the direction and supervision of the City Prosecuting Attorney. The Deputy City Prosecuting Attorney is responsible for assisting in the prosecution of all criminal misdemeanors, traffic violations and violations of city ordinances arising in the City of Fort Smith and prosecuted through the Fort Smith District Court. The City Prosecutor&rsquo;s Office has concurrent misdemeanor jurisdiction with the Sebastian County Prosecuting Attorney except in those misdemeanor cases specifically designated for prosecution by the Sebastian County Prosecuting Attorney. The City Prosecutor shall exercise exclusive jurisdiction over violations of city ordinance. The Deputy City Prosecuting Attorney is responsible for assisting with the activities of the City Prosecuting Attorney in the execution of his/her office. 
 
Essential Duties And Responsibilities include the following. Other duties may be assigned. 
 
1. Assume the responsibility and operations of the City Prosecuting Attorney Office in the absence of the City Prosecuting Attorney. Ensure that all activities are performed in an ethical and professional manner and serve the best interest of the citizens of the City of Fort Smith; 
2. Provide assistance in criminal investigations, provide advice on charges to be filed and the evidence that will support them. Provide answers to questions relating to criminal procedure. Act as a liaison with other prosecuting authorities, the various courts and with other law enforcement authorities; 
3. Review police reports and citizen complaints, investigate those reports and citizen complaints if needed, prepare and file appropriate criminal charges, traffic violations and violations of city ordinance. Prepare search warrants and affidavits for the issuance of warrants of arrest; 
4. Review driver histories and criminal histories before making a recommendation for filing or disposition. Obtain evidence of prior criminal convictions and DWI&rsquo;s prior to plea or trial; 
5. Attend arraignments and make recommendations to the court regarding bonds, pleas and dispositions. Review arraignment dockets to determine cases seeking jail time; 
6. Assist the City Prosecuting Attorney in preparing for trial by interviewing witnesses and reviewing all evidence prior to trial. File relevant motions and respond to motions filed by a defendant. Conduct necessary legal research on issues arising before the court and provide briefs when required; 
7. Engage in plea negotiations with defense counsel and pro se defendants and present those agreements to the court. Seek restitution for victims in appropriate cases. Monitor the payment of restitution and take legal action in cases in which restitution is not paid as the court ordered. Upon entry of a judgment in Circuit Court or other appellate court, the Prosecutor will provide the District Court Clerk with a copy of the appellate court&rsquo;s judgment. The Prosecutor shall be responsible for monitoring all terms and conditions that are part of the appellate court&rsquo;s judgment and taking appropriate action; 
8. Request that the court issue a warrant for failure to appear when a defendant does not appear for court, prepare witness lists and submit subpoena requests electronically to the district court business office so that the clerk of the court can issue subpoenas. Draft and file petitions to revoke suspended sentences; 
9. Interact with the public, law enforcement and city officials to determine and develop ways of addressing ongoing and/or potential criminal activity and violations of city code. Facilitate the exchange of information and encourage the development of open lines of communication between these groups; 
10. Cover duties, trials and specialty court team duties during the absence of the City Prosecuting Attorney; 
11. Complete at least 12 hours of Continuing Legal Education (CLE) each year as required by the Arkansas Supreme Court in order to maintain a current Arkansas Law License. The primary focus of the CLE should deal with issues of criminal law, criminal procedure or the prosecution of traffic offenses. The CLE should also afford him the opportunity to review the most current criminal case law as well as new methods of prosecuting criminal defendants; 
12. Perform other duties and special projects as assigned; 
13. Regular attendance and timeliness is required.

Job Summary
The Deputy Prosecuting Attorney represents the State of Idaho as a trial attorney in the prosecution of criminal, quasi-criminal, and limited civil actions in Juvenile, Magistrate, and District Court proceedings and assist the elected Prosecuting Attorney in performing the statutory and constitutional functions of the office. 
This is a multi-level class series in which incumbents may be assigned to any of five levels, depending on organizational needs, professional legal experience, individual expertise and skill, proficiency, and complexity of assigned caseload. Positions in these classes are flexibly staffed and are normally filled by advancement from the entry level. Progression from one level to the next is at the discretion of the appointing authority, provided minimum qualifications are met. 
Positions within the class:
Rule 226 Provisional Deputy is the pre-entry level in the Deputy Prosecuting Attorney (DPA) series, assigned to law students and recent law school graduates studying for the Bar Exam. Provisional Deputies are legal interns admitted under Idaho Bar Commission Rule 226 to the limited practice of law.
Deputy Prosecuting Attorney I is the entry level in the (DPA) series, assigned to employees with limited previous legal experience who are fully licensed to practice law in the State of Idaho. This class is typically used as a training class and employees work under immediate supervision while learning job skills and tasks.
Deputy Prosecuting Attorney II is the first working level assigned to employees with at least the equivalent of one year as a DPA I. Under general supervision, employees at this level perform work of average difficulty in all phases of criminal, quasi-criminal, and limited civil practice.
Deputy Prosecuting Attorney III is the full journey level assigned to employees with the equivalent of at least two years&rsquo; experience as a DPA. Employees at this level are assigned increasing difficult and complex cases and should require limited instruction or assistance.
Deputy Prosecuting Attorney IV is the senior journey level assigned to employees with the equivalent of at least three years&rsquo; experience as a DPA. <div>The Chief Deputy Court Clerk performs a variety of clerical and administrative support tasks to support the operations of the municipal court. The Chief Deputy Court Clerk works under the direction of the Court Clerk and Municipal Judge while court is in session.
Essential Job Functions:<ul><li> Preservation, maintenance and dissemination of all records originating out of the municipal court.</li><li> Collection of all fines and fees assessed in the municipal court</li><li> Accurate record keeping of fine and fee payments.</li><li> Attends all court sessions on scheduled court dates to assist the Judge, Prosecutor, attending attorneys and defendants.</li><li> Record keeper for all municipal court orders, judgements, dockets and minutes.</li><li> Determines what information is a public record and can be released without redaction.</li><li> Assists the court clerk with supervising the daily operations of the clerk&rsquo;s office including the supervision of other deputy court clerks.</li><li> Assists the court clerk in Interviewing candidates for open deputy clerk positions and makes recommendations for hiring new staff.</li><li> Assists the court clerk with performance evaluations of deputy court clerks and makes recommendations concerning promotions and disciplinary actions.</li><li> Assists the court clerk with budget preparation.</li><li> Assists the court clerk with technology issues.</li><li> Assists the court clerk with purchasing and facility needs.</li><li> Assists the court clerk with financial and state reporting requirements.</li></ul> 
Knowledge, Skills and Abilities:<ul><li> Excellent use of verbal and written communication skills.</li><li> Attention to detail and ability to verify the accuracy of the work performed by other deputy clerks.</li><li> Knowledge of court case management systems with preference for experience with Incode Version 9.</li><li> Knowledge of Microsoft Office including Outlook, Word and Excel.</li><li> Excellent team building and conflict resolution skills.</li><li> Knowledge of budgetary process in municipal government.</li><li> Ability to multitask in a face-paced environment.</li></ul> 
Education and Experience:
High school diploma required; Bachelor&rsquo;s or Associate&rsquo;s degree in criminal justice or public administration preferred. 5 years experience as a head court clerk or court administrator in a municipal court is required. Experience with InCode software version 9 is preferred.</div>
