Responsibilities:</b></p><ul><li>
Arbitrations and Administrative Tribunals</li></ul><div>
Serve as the authority&rsquo;s legal advocate in contract grievances, disciplinary cases, arbitrations, trials, mediations, and administrative proceedings, ensuring that the Authority&rsquo;s position is effectively presented. Formulates litigation strategy and settlements, prepares witnesses, gathers evidence, researches legal issues, drafts legal briefs and other litigation papers, presents oral arguments to arbitrators, mediators, and Administrative Law Judges.
</div><ul><li>Serve as counsel to Authority management, providing day to day advice and legal evaluation in connection with disciplinary matters, labor issues, New York State Civil Service Law, contract interpretations, and policy formation. Ensure compliance with the legal obligations required under the collective bargaining agreements as well as under New York State and Federal law.</li><li>
Review labor legislation and formulate the Authority&rsquo;s statement in support/statement in opposition to legislation. Ensure the Authority&rsquo;s position on proposed legislation is delivered timely to the MTA&rsquo;s legislative team.</li><li>
Evaluate evidence, assess possible litigation outcomes, draft disciplinary charges, formulate proposals, day to day contact and negotiations with union representatives to resolve litigation matters, and respond to information requests / FOIL requests for information sought by labor.</li><li>
Participate in collective bargaining negotiations, record minutes of collective bargaining negotiations, assist in developing collective bargaining strategies, and ensure the smooth implementation of collectively bargained terms. Negotiate labor contracts within cost guidelines and patterns set by the MTA.</li><li>
Participate in Labor/Management meetings. Prepare minutes from prior Labor/Management meetings. Address and resolve issues without the need for grievances or litigation, and maintain a channel of effective communication with the unions.</li><li>

This position is accountable for providing legal advice and/or representation in various legal bodies on all labor relations matters associated with the operation of the Metropolitan Transportation Authority, its affiliates, and/or subsidiaries. In addition, the selected candidate may participate in labor contract negotiations and implementations of collective bargaining agreements.
</p><p><b>Responsibilities:</b></p><ul><li>
Provides legal advice and representation, as well as continuous in-house legal guidance to MTA HQ, MTA Agencies, and/or senior staff on a wide variety of litigation and non-litigation labor and related matters.
</li><li>Provide legal and strategic advice concerning ongoing contract negotiations to ensure contract settlements are consistent with the organization&rsquo;s goals and objectives. Assist with developing a plan for increasing MTA organizational effectiveness and efficiencies through proposed modification of collective bargaining contract provisions and practices.
</li><li>Work closely with Agency labor relations teams to review, coordinate, formulate, and establish MTA Labor Relations&rsquo; position on proposed legislation and coordinate the preparation of all related correspondence.</li><li>
Ensure labor policies, practices, and agreements developed during prior MTA HQ and/or individual or various MTA Agencies consolidations are integrated into the development and outcome of future consolidations to maintain consistency throughout MTA HQ departments and/or MTA Agencies.
</li><li>Identify issues of potential conflict arising from the consolidation process and participate in recommending and achieving concrete resolutions. Draft agency policies and reconcile any related inconsistencies.
</li><li>Prepares bulletins, informational memos, and oversees the dissemination of instructional materials aimed at providing MTA HQ management, as well as other MTA Agencies, with the tools needed to properly and effectively navigate the broad array of applicable rules and working conditions resulting from the consolidation process.</li><li>

Governance and Reporting</li><li>
Track KPIs, prepare board/leadership updates, manage legal holds, records retention, and budget for labor matters.</li><li>
Annual labor strategy and compliance plan; updated policies/handbooks.</li><li>
Negotiated CBAs and grievance/arbitration outcomes.</li><li>
Training calendar and completion metrics.</li><li>
Quarterly labor governance dashboard and budget report.</li><li>

The position will be based at the Company&rsquo;s headquarters in North Bethesda, MD and will be a member of the Labor, Employment and Benefits Group (&ldquo;LE&amp;B Group&rdquo;) in the Sodexo Law Department.</p><p>
The LE&amp;B Group supports the United States subsidiary of a large global company that provides contracted management services, primarily food and environmental services, to a variety of institutions, including hospitals, colleges and universities, corporations, senior living communities and entertainment venues. The LE&amp;B Group serves as a trusted partner to operations leadership and various departments within Human Resources, including Segment HR Business Partners, Employee Relations, Labor Relations, Total Rewards, Talent Acquisition, and Learning &amp; Development.</p>
What You'll Do:
<p><b>KEY RESPONSIBILITIES</b>:</p><ul><li>
Provide advice and counseling to internal human resources and operations clients on a wide range of employment law-related matters including hiring and recruiting, employee relations, discipline and termination, leaves of absence, reasonable accommodation, workforce restructuring, wage and hour compliance, and compensation and benefits.</li><li>
Investigate and respond to attorney demand letters and charges of unlawful conduct filed with various federal and state agencies.</li><li>
Manage outside counsel and serve a key strategic role in defense of employment litigation.</li><li>
Support the current Assistant General Counsel, Labor with labor law-related matters, including advising Labor Relations on union organizing and negotiating, responding to NLRB charges and election petitions, and handling labor arbitrations.</li><li>
Advise on legal issues relating to executive compensation and benefits (ERISA); serve as conduit between outside benefits counsel and Operations/HR.</li><li>
Ensure compliance with federal, state, and local employment and labor laws, and serve as a subject matter expert in certain specialized areas of interest.</li><li>
Assist in development of written employment policies and practices</li></ul>
