JOB DESCRIPTION
 Provides support and expertise to the Assistant District Attorney in investigating moderate to complex level cases and cases requiring special skills.
 
Management Scope: May train and/or supervise staff.
 RESPONSIBILITIES
 1. Assists the Assistant District Attorney in gathering pertinent data, identifying significant factors and recognizing solutions for moderate to complex or specialized cases.
 
2. Locates and develops evidence to assist in plea negotiations.
 
3. Works independently in planning and organizing work as part of a trial or section and in preparing cases for disposition.
 
4. Assists in reconstructing events, sequences, and time elements in preparation of criminal cases.
 
5. Locates, interviews, and notifies witnesses of trial dates by means of serving subpoenas, summons, and writs, and/or making arrests and coordinates transportation and lodging of trial witnesses, and checks background of witnesses that may be used during trial.
 
6. Collects and prepares physical evidence for trial and reviews various reports such as medical autopsy and forensic reports as part of the investigative process.
 
7. Assists the Assistant District Attorney during the jury selection and trial phases.
 
8. Trains Level I investigators and/or Legal Assistants; and acts as lead when more than one Investigator is required
 
9. Performs other duties as assigned.
 QUALIFICATIONS
 
Education, Experience and Training: 
Must have passed a general educational development (GED) or hold a high school diploma. Bachelor’s degree from an accredited college or university in a job related field of study. Two (2) years peace officer experience, OR Intermediate Peace Officer Certificate from T.C.L.E.O.S.E. and no experience.
 
Special Requirements/Knowledge, Skills & Abilities: 
Must be a Certified Peace Officer and proficient in the use of a firearm. Knowledgeable of investigative techniques and ability to communicate both verbally and in writing with a diverse group of individuals. Skilled at applying interviewing techniques while assisting the prosecutors in adverse or hostile conditions. Must pass criminal background investigation. This position may require successful completion of a polygraph exam, psychological exam, physical exam and extensive background investigation and is subject to random, unannounced drug/alcohol testing.
 
Physical/Environmental Requirements: 
Standard office environment 50% of the time with the remainder of time spent in a typical law enforcement street environment.

Primary Duties: The Medicaid Fraud Control Unit (MFCU) is currently accepting applications for a Criminal Investigator or Investigative Auditor position. The federally funded and mandated MFCU is an interdisciplinary team dedicated to protecting vulnerable individuals and safeguarding the finite resources on which they depend. This position is responsible for conducting complex criminal investigations involving Medicaid provider fraud, patient abuse, neglect and financial exploitation. BRIEF DESCRIPTION OF DUTIES:

Incumbent of position is a member of DFS&rsquo; Disaster Response Team and, in that capacity, may be required on short notice to perform duties and necessary attendant travel in support of disaster relief efforts. 


The duties of this position require a constituted law enforcement officer subject to be on call 24 hours a day, seven days a week. The incumbent is required to bear firearms. Office of the Metropolitan Transportation Authority Inspector General: 
The Office of the Metropolitan Transportation Authority (MTA) Inspector General (OIG) reviews and investigates the operations of the MTA and its contractors. The MTA, which employs over 70,000 people, includes among other entities, New York City Transit, the Long Island Rail Road, Metro-North Railroad, MTA Bridges &amp; Tunnels, Staten Island Rapid Transit, and MTA Construction &amp; Development.
 Position Summary: 
Reporting directly to the Executive Deputy Inspector General for Legal (&ldquo;EDIG/Legal&rdquo;), the Senior Investigative Attorney directs and conducts confidential inquiries and investigations into complex allegations of fraud, waste and abuse in the operations and management of the MTA, its subsidiary agencies and contractors.
 
 
Duties and Responsibilities:<ul><li>
Serves as the team lead, responsible for the planning, conducting, and reporting on confidential investigative inquiries, providing legal and investigative direction to team members.</li><li>
Identifies issues and avenues of investigative inquiry and develops a plan to assess their significance.
</li><li>Conduct interviews of agency and other personnel and prepares clear and concise interview memoranda.</li><li>
Develops and maintains professional working relationships and continually gains knowledge of evolving MTA agency operations.</li><li>
Conducts applicable legal research and analyzes documents related to confidential inquiries and investigations.</li><li>
Provides legal and investigative advice and support to the investigative and audit team members on confidential inquiries and investigations.</li><li>
Drafts comprehensive case memoranda, case summaries, subpoenas and other legal documents.
</li><li>Develop appropriate recommendations to improve agency operations, cost-efficiency, safety and assist the Audit Division with audits of MTA operations and processes.
</li><li>Prepares professionally written reports and referral letters on the investigative inquiry.</li><li>
Provides accurate and precise case progress reports on the status of the inquiry and avenues of investigation being pursued to the EDIG/Legal and other members of the Executive Staff, including the Inspector General.</li><li>
Represents the OIG at meetings with MTA officials, MTA subsidiary agencies and contractors, as well as with external local, state and federal agencies, including prosecutors&rsquo; offices.</li><li>
Assists in preparing MTA/OIG staff to testify at disciplinary hearings, arbitrations and court proceedings.</li><li>
Travel within the MTA geographic jurisdiction may be required.</li></ul> 

Qualifications/Relevant Experience:<ul><li>
A Bachelor&rsquo;s Degree from an accredited educational institution and a Juris Doctor from an accredited law school.</li><li>
Admission to the New York State Bar.</li><li>
Minimum of six years of legal experience, including substantial experience in conducting complex civil or criminal investigations or reviews, including legal research, interviews, pre-trial motion practice, litigation of trials and hearings, legal research, and brief writing.
</li><li>Familiarity with reviewing and interpreting high volumes of complex data, including, but not limited to, bank and financial records, cell phone records, time &amp; attendance records.
</li><li>Excellent analytical, organizational, inter-personal and oral and written communication skills.</li><li>
Ability to articulate the critical issues in a case accurately and precisely both orally and in writing.</li><li>
Demonstrated good judgment in assessing legal and investigative issues.</li><li>
Excellent writing skills for documenting interviews, summarizing evaluation findings, and drafting reports.</li><li>
Ability to work independently and with minimal supervision.</li><li>
Ability to work as a member of an investigative team, fostering a supportive, respectful and collaborative environment with professional, investigative and support staff.</li><li>
Technical proficiency including knowledge of and experience with Microsoft Office 365 suite and modules, eDiscovery platforms and case management software.</li><li>
Ability to handle multiple projects while maintaining careful attention to detail and accuracy.</li><li>
Ability to interact effectively with department and agency staff, senior management and executive staff within the MTA/OIG and external offices and agencies.</li><li>
Subject to the approval of the EDIG/Legal, this position is eligible for hybrid teleworking.</li></ul>
