The responsibilities and authority of the Prosecutor are established by common law, statute, court rule and appellate case law. There are over 700 separate statutes and court rules imposing duties and responsibilities on the Prosecutor.

Under Michigan law (MCL 49.32) the Chief Assistant Prosecuting Attorney is required to discharge all the functions and perform all the duties of the Prosecutor in the event of sickness, disability, or absence by the Prosecutor.

Responsibilities and Duties:

The Chief Assistant Prosecutor serves at the pleasure of the Prosecutor and, at the discretion of the Prosecutor, is required to perform all duties and tasks necessary to carry out the Prosecutor&rsquo;s responsibilities and functions. These duties and tasks include, but are not limited to:
