Job Description
 
The United States Attorney's Office for the District of Minnesota is accepting applications for AUSA openings in our Civil Division.
 
The Civil Division handles a wide variety of civil cases, including healthcare and procurement fraud, civil rights enforcement, constitutional challenges to statutes and regulations, environmental defense and enforcement, financial litigation, bankruptcy, asset forfeiture, immigration, and the defense of employment discrimination and tort claims.
 
AUSAs in the Civil Division are responsible for representing the federal government and its agencies and employees in civil litigation in the district. These AUSAs conduct pre-trial investigations and handle all aspects of civil litigation, including taking and defending depositions, propounding and answering discovery, engaging in motions practice, trying cases, negotiating settlements, drafting appellate briefs, and arguing cases before appellate court judges. AUSAs are expected to work independently and in teams with other AUSAs and federal government agencies.
 
The attorney selected to fill the civil vacancy will engage in a broad civil, federal litigation practice across many of the different subject matters described above in the District of Minnesota. AUSAs in the civil division manage a high-volume docket of affirmative and/or defensive cases, depending on the needs of the office, as well as the interests and experience of the particular AUSA. AUSAs will work with a broad spectrum of federal agencies, representing the interests of the United States in federal court. For many matters, AUSAs will also have the opportunity to work closely with many different divisions within the Department of Justice. Job Description
 
The United States Attorney is seeking an experienced appellate lawyer to serve as an Assistant United States Attorney (AUSA). The AUSA's main responsibility will be briefing and arguing direct criminal appeals before the United States Court of Appeals for the Ninth Circuit. The AUSA may also handle civil appeals, will litigate habeas cases in district court and the court of appeals, and will assist trial prosecutors throughout the district including handling district court briefing and hearings on emerging legal issues. Although the practice will be primarily appellate, the AUSA may also be called upon in certain cases to join a trial team and assist in trying cases in the district court. The district's appellate caseload is extremely heavy; the AUSA can expect to be responsible for a variety of matters at any one time.
 
Qualifications
 
Required Qualifications:

Job Description
 
Responsibilities will include objecting to bankruptcy plans proposed under chapter 11 and 13 of the Bankruptcy Code, reviewing (and opposing where necessary) proposed asset sales in bankruptcy, prosecuting motions to dismiss or convert bankruptcy cases from one chapter to another, protecting federal agencies' interest in cash collateral, obtaining determinations regarding the discharge ability of federal debts, and responding to objections to federal agencies' claims.
 
The position will also require defending the following types of lawsuits filed in Bankruptcy Court: (i) complaints to determine the discharge ability of federal debts, (ii) complaints to determine the extent, validity or priority of federal liens, and (iii) complaints to recover pre-bankruptcy payments to federal agencies.
 
Typical agencies represented include the Department of Treasury (including the IRS), the Department of Health and Human Services, the Small Business Administration, the Department of Veterans Affairs, the Department of Agriculture, the Department of Defense, the Department of Housing and Urban Development, and the Department of Education.
 
The candidate may be assigned other financial and debt collection litigation matters, according to office needs.
