High-Volume Debt Collection | Court Appearances & Motion Practice

$85,000 + annually, commensurate with experience, scope of responsibility, and level of in-house engagement.

Mountain Land Collections is seeking a Utah-licensed attorney to assume primary responsibility for court appearances and related motion practice in a high-volume debt collection practice (primarily medical debt). This role is ideal for an attorney looking to add consistent, predictable revenue to an existing practice without the pressure of business development or administrative tasks. Ideal for an experienced attorney who prefers applying legal judgment and skills rather than building processes or managing day-to-day file preparation.

Our objective is efficient, professional resolution—hopefully through settlement and negotiated payment arrangements with largely pro se defendants. Trial work is not a regular component of this role, though occasional trials (typically 2 hours or less) may be required.

Core Responsibilities

1. Court Appearance Counsel (Primary Function)

• Appear (almost entirely virtual appearances) on stacked law & motion calendars for debt collection matters
• Typically 5–10 cases per calendar, with appearances usually lasting under 45 minutes
• Appear approximately 4–8 times per month initially (capacity for more)
• Negotiate settlements with pro se defendants, often involving payment plans and/or discounts
• Review concise case summaries prepared in advance by support staff
• Appearances before multiple Utah judges; familiarity develops quickly due to consistency of cases

2. Motion Practice – Pro Se Matters

• Review, finalize, and/or prepare responses to pro se motions, including:
• Motions to Set Aside Judgment
• Motions to Dismiss and similar filings
• Volume typically 1–4 motions per week
• Time is spent typically refining and approving drafts prepared by staff
• Appearance (almost entirely virtual) at scheduled hearings—if any. Usually stacked as part of law & motion calendars for debt collection matters

3. Summary Judgment Opportunities (Optional / Growth Area)

• Opportunity to expand use of Motions for Summary Judgment
• Appear (99% virtual) for oral argument when scheduled
• Systems and volume already exist to support increased filings

Typical Case Profile

• Primarily medical debt collections
• Clean, well-documented accounts
• Common defenses include:
• “I didn’t know about the debt”
• “My insurance should have paid”
• “I can’t afford to pay”
• Defendants are primarily pro se

Qualifications

• Active Utah law license in good standing
• Comfort appearing in Utah courts
• Strong negotiation and communication skills
• Ability to quickly grasp simple factual records
• Prior collections, creditor rights, or high-volume civil experience is a plus—but not required

• This position offers a hybrid work arrangement, combining mostly remote work with periodic in-office presence (American Fork)
• Self-directed schedule with responsibility for managing workload and court appearances
