<div><div><p>The Tucson branch of the United States Attorney&rsquo;s Office for the District of Arizona has primary responsibility for prosecuting federal crimes occurring in and relating to Southern Arizona. Law student clerks will attend on-site and handle research and writing projects from the offices of Criminal, Civil, and Appellate Divisions:</p><p><b>
Criminal Division</b><b>:</b> Assistant U.S. Attorneys working in the Criminal Division prosecute violations of the federal criminal code including: narcotics trafficking crimes, violent crimes occurring on the Indian reservations and federal facilities, such as military bases and prisons, located in southern Arizona (including homicides, child abuse, sex offenses and bank robberies), white collar crimes (including mortgage fraud, tax fraud, money laundering), crimes affecting the national security of the United States (including weapons smuggling, commercial airplane travel, and terrorism) and crimes particularly prevalent in the southwest border states (including illegal reentry, drug smuggling, alien smuggling, and human trafficking).</p><p><b>
Appellate Division</b><b>:</b> Assistant U.S. Attorneys working in the Appellate Division research and write appellate briefs and conduct oral argument on behalf of the United States before the Ninth Circuit Court of Appeals. They also provide legal advice to the attorneys in the Civil and Criminal Divisions and help draft pleadings of first impression. In addition to working on appellate briefs, law clerks may be invited to attend and actively participate in moot courts that are conducted in-house prior to every Ninth Circuit oral argument.</p><p><b>
Civil Division</b><b>:</b> Assistant U.S. Attorneys working in the Civil Division handle an extensive volume of cases, including defending the actions of federal agencies, handling Freedom of Information Act and Privacy Act cases, defending medical malpractice actions and employment discrimination claims, and defending Federal Tort Claims Act cases. Attorneys also represent federal law enforcement officers. The Civil Division handles bankruptcy matters, and contains the Financial Litigation Unit, which handles collections on behalf of the government.</p></div>
</div></div><div><div><b>Job Description</b></div>
<div><div><p>While being mindful of the office&rsquo;s inherent confidentiality guidelines, law clerks will conduct legal research and draft motions and pleadings filed in U.S. District Court and will have the opportunity to assist with court and trial preparation. Clerks may also have the opportunity to help draft appellate briefs filed with the Ninth Circuit Court of Appeals. Law clerks are encouraged to watch federal court proceedings, especially trials and sentencings, attend in-house legal trainings, and explore federal practice and procedure one-on-one with AUSAs.</p><p>
Successful applicants should: 1) be proactive self-starters who are interested in working in a fast-paced environment offering a variety of opportunities and experiences; 2) have solid research and writing skills; and 3) have a demonstrated interest in public service, particularly including experience working in a prosecution office. Clerks will be given assignments in as many different practice areas and with as many different attorneys as possible, providing exposure to a number of subject matters and styles of practice. Additionally, interested individuals participating in the Summer Clerkship Program will have the opportunity to have fully guided behind the scenes tours of a port of entry facility along the U.S./Mexico border, as well as of a federal prison.</p></div>
</div></div><div><div><b>Qualifications</b></div>
<div><div><p>Enrolled in an ABA-accredited law school and be a <i>rising</i> 2L or 3L. Graduates cannot be considered for this particular posting, per DOJ policy. <b>Must also be a U.S. citizen</b>, per DOJ. Strong grades and excellent research and writing skills. Completion of courses in Evidence and in Criminal Law or Procedure are a plus, but not required. A background check must be completed upon acceptance of the clerkship offer because of the sensitive nature of the work performed by the United States Attorney&rsquo;s Office. Prior criminal arrests and/or convictions, <i>illegal</i> drug or alcohol use, and tax issues could disqualify the student. Regarding summer applicants, those who are available for at least 10 weeks during that semester are preferred due to the expenses involved in the background checks.</p></div>

Duties of Criminal Assistant United States Attorneys
<br><br>
<b>The Criminal Division is organized into three sections:</b> General Crimes, Organized Crimes and Special Prosecution. The General Crimes Section is comprised of four units: Intake, Fast Track, three Trial Teams, and the Sentencing Unit. Most Criminal AUSAs begin their careers in General Crimes. General Crimes handles a large volume of reactive cases that arise from policing the 141-mile-long border between California and Mexico, six Ports of Entry, and the roughly 70 miles of coastline stretching from the U.S./Mexico border to the northernmost tip of San Diego County. Such cases commonly include illegal entry and reentry, drug importation and smuggling, and alien smuggling. Aside from their reactive cases, prosecutors in the section also handle firearms-related matters, drug distribution, child exploitation, fraud, and other prosecutions. General Crimes prosecutors try a large number of cases and conduct proactive investigations using a wide range of investigative tools and pursue matters involving undercover operations and confidential sources.

Term Assistant U.S. Attorney

<p></p><div><div><div><div><div><div><div><div><div><div><div><div><p>Under the general direction of the Special Agent Supervisor, the Special Investigator (SI) evaluates and investigates civil and criminal allegations and violations of law on behalf of the Office of the California Attorney General, Division of Medi-Cal Fraud and Elder Abuse (DMFEA). The SI selected will be assigned to the Facilities Enforcement Team (FET), which plays a unique and critically important role in ensuring the safety and care of elderly and dependent persons residing in nursing homes and other long-term care facilities by prosecuting allegations involving systemic fraud, abuse, and neglect in criminal and/or civil state court actions.
</p><p>The SI conducts civil investigations independently and as a part of an interdisciplinary team of Special Agents and Deputy Attorney Generals to detect and investigative suspected violations that fall under the jurisdiction of DMFEA; obtaining and verifying evidence to support civil enforcement; interviewing witnesses and victims, reviewing and analyzing documents; conducting and completing investigations; testifying in civil proceedings; maintaining accurate case files; providing technical assistance and training; preparing clear, concise and accurate reports. The SI independently performs assigned tasks skillfully, professionally, courteously, and efficiently, exercises independence, initiative, and excellent judgment. Interns are assigned to prepare these memoranda in a broad range of cases, including cases involving suppression of evidence, dismissals of indictments, post-verdict judgments of acquittal, and adverse sentencing determinations. The legal issues are quite varied, and often involve constitutional questions, questions of statutory interpretation, or the correct application of the Sentencing Guidelines. Interns also assist Section attorneys with researching and writing briefs to be filed in the Supreme Court and federal courts of appeals and are invited to participate in moot courts. The Computer Crime and Intellectual Property Section (CCIPS) is responsible for implementing the Department’s national strategies in combating computer and intellectual property crimes worldwide. Section attorneys work to improve the domestic and international infrastructure-legal, technological, and operational-to pursue network criminals most effectively. Law interns work with CCIPS attorneys on cutting edge legal issues relating to computer and intellectual property crime, cryptocurrency, and electronic evidence. Typical intern projects involve researching novel legal issues, drafting documents for active cases, analyzing policy proposals, and helping to draft Section publications.

Qualifications
<br><br>
Interns must be enrolled in an accredited law school and must have: (1) a strong academic background; (2) excellent research and writing skills; (3) interest in criminal justice; and (4) experience with or interest in computers, telecommunications networks or other emerging technologies.

Summer and semester interns must have completed at least one year of law school and be willing to work full-time with the Section. Summer interns must commit to working at least eight weeks. Academic semester interns must commit to at least 30 hours per week through a formal externship program.

<div><div><p>The Human Rights and Special Prosecutions Section (HRSP) protects the American public and U.S. interests by investigating and prosecuting complex international immigration and violent crime cases over which the U.S. has jurisdiction, specifically against: (1) leaders and members of criminal networks and cartels responsible for prolific international alien smuggling, human trafficking, and related immigration fraud crimes; (2) persons who have committed genocide, torture, war crimes and other atrocities outside the United States, including those who then flee to the United States seeking safe harbor or commit immigration fraud by concealing their past crimes; and (3) persons who committed violent crime abroad where a U.S. citizen is a victim or perpetrator.</p><p>
Combatting the Dangers of Human Smuggling, Trafficking, and Related Immigration Crimes<br>
HRSP investigates and prosecutes complex immigration offenses that undermine the integrity of our nation's borders and our national security. HRSP targets international criminal networks and cartels involved in smuggling of aliens, placing particular emphasis on prosecuting the leaders and organizers of those organizations to eliminate those international networks that terrorists and other criminals could exploit to enter the United States without detection. HRSP also prosecutes human trafficking crimes. The office leads Joint Task Force Alpha (JTFA), an inter-agency partnership between DOJ and DHS that combines dedicated prosecutors, agents, and analysts with specialized expertise from across the country to build criminal cases against leaders, organizers, and facilitators of human smuggling and trafficking crimes. JTFA targets criminal networks operating along the southern and northern borders and the Caribbean that smuggled aliens into the United States.</p><p>
Ensuring Accountability for Human Rights Violations and Related Immigration Crimes<br>
Where U.S. federal jurisdiction exists, HRSP seeks to prosecute persons who have committed atrocity crimes abroad under the federal criminal statutes proscribing torture, war crimes, genocide, female genital mutilation, and recruitment or use of child soldiers. The Section also prosecutes human rights violators under other statutes as appropriate, including U.S. criminal and civil immigration and naturalization laws in order to revoke U.S. citizenship or other legal status and obtain criminal penalties as appropriate. HRSP is also part of a coordinated, interagency effort to deny safe haven in the United States to human rights violators, working closely with the Department of Homeland Security and the Department of State, among other agencies, to identify such individuals and prevent them from entering the United States.</p><p>
Prosecution of International Violent Crimes<br>
HRSP prosecutes certain other cases of crimes of violence committed abroad, particularly crimes that fall under the Military Extraterritorial Jurisdiction Act (MEJA). In its MEJA enforcement work, HRSP coordinates and participates in investigations and prosecutions of individuals employed by or supporting United States military forces overseas who commit murder, sex crimes, and other federal felony offenses. Similarly, HRSP investigates and prosecutes cases involving violent crimes that fall under the Special Maritime and Territorial Jurisdiction of the United States.</p><p>
Interagency and International Work<br>
HRSP is part of a coordinated, interagency effort to deny safe haven in the United States to human rights violators. The U.S. Attorney's Office for the District of Columbia is unique in the size and the scope of its work. It serves as both the local and the federal prosecutor for the nation's capital. On the local side, AUSAs assigned to the Superior Court Division prosecute cases in the Superior Court of the District of Columbia ranging from misdemeanors to homicides, and appeals of those convictions are argued in the District of Columbia Court of Appeals (DCCA). On the federal side, AUSAs assigned to the Criminal Division prosecute federal crimes in the U.S. District Court for the District of Columbia, and appeals of those convictions are argued in the U.S. Court of Appeals for the District of Columbia Circuit. AUSAs assigned to the Appellate Division argue the direct appeals of all criminal convictions in both the local and federal Courts of Appeal. AUSAs in the Special Proceedings Division handle post-trial litigation involving habeas claims, record sealing, and other requests for extraordinary relief in the trial courts. The Civil Division further defends the United States in civil suits brought in the District of Columbia.

Law Student Interns will be responsible for drafting various legal documents such as responsive motions, dispositive motions, memoranda of law, and appellate briefs. They will also gain familiarity with the Federal Rules of Civil and Criminal Procedure, the Federal Rules of Evidence, the local rules of practice for the District of Columbia Court, and the local and Federal rules of Appellate Procedure. Interns may also attend dispositions and meetings with agents and accompany attorneys to observe court proceedings. Responsibilities increase and assignments become more complex as training and experience progress. This DMFEA Deputy Attorney General position prosecutes complex criminal cases in state court involving (1) fraud committed against the Medi-Cal program by doctors, pharmacies, medical equipment suppliers, and the rest of the full range of Medi-Cal providers, and (2) criminal abuse and neglect of elders and dependent adults in skilled nursing and other residential care facilities.<br>

<div>DMFEA is a vertical prosecution unit, where prosecutors work closely with in-house special agents and investigative auditors. The prosecutor advises DMFEA&rsquo;s investigators on their investigative plans, reviews search and arrest warrants, and determines charges to bring. The prosecutor is then responsible for the criminal prosecution, from filing through conviction and sentencing.</div><div></div><div><br>

The Disability Rights Section protects the rights of persons with disabilities under Titles I, II and III of the Americans with Disabilities Act ("ADA"). The ADA prohibits discrimination on the basis of disability in over seven million places of public accommodation, including all hotels, restaurants, retail stores, theaters, health care facilities, convention centers, parks, and places of recreation (Title III), in all activities of over 80,000 state and local governments (Title II), and in all employment practices of state and local government employers with 15 or more employees (Title I).In addition, under Executive Order 12250, the Section coordinates and ensures consistent and effective enforcement of Section 504 of the Rehabilitation Act of 1973, which prohibits discrimination based on disability in federally assisted and federally conducted programs and activities. Enforcement of the ADA requires the Section to perform complaint investigations and compliance reviews. It is also responsible for the design and implementation of litigation under Titles I, II and III of the ADA.

As the Chief of the Disability Rights Section, the successful candidate will lead the enforcement of Titles I, II, and III of the Americans with Disabilities Act (ADA), the Rehabilitation Act of 1973 (Section 504), and associated federal civil rights statutes. The incumbent directs high-impact civil rights litigation, regulatory work, policy development, investigations, and outreach activities nationwide.

<b>The Chief's core responsibilities include:</b><br>
Leading investigations and litigation under Titles II and III of the ADA, and litigation against public employers under Title I based on referrals from the Equal Employment Opportunity Commission (EEOC) or the Attorney General's independent authority.
<br>Managing review and certification of state and local building codes for compliance with ADA Standards for Accessible Design.
<br>Coordinating enforcement of Title II across federal agencies and providing legal advice and counsel to federal partners on disability-related matters.
<br>Directing investigations and compliance reviews involving law enforcement, corrections, courts, public safety, and access to public services and programs.
<br>Overseeing issuance of regulations to implement Titles II and III of the ADA, including those related to architectural accessibility and reasonable modifications.
<br>Supervising the ADA Mediation Program, enabling efficient resolution of complaints from individuals with disabilities across the U.S.
<br>Managing the ADA Information Line and overseeing public education initiatives, including development of accessible resources and publications.
<br>Representing DOJ as a voting member of the Architectural Transportation Barriers Compliance Board, contributing to federal regulatory changes under Section 504.
<br>Reviewing and approving legal briefs, reports, and arguments to ensure alignment with Departmental policy and applicable precedent.
<br>Collaborating with senior DOJ officials, including the Assistant Attorney General for Civil Rights, on major litigation, enforcement strategy, and policy development.
<br>Consulting with the Attorney General, Deputy Attorney General, and Associate Attorney General on complex legal and programmatic matters impacting civil rights.
<br>Supervising case development including complaint review, pre-trial litigation, discovery, motions practice, and appeals; and overseeing requests for FBI investigatory support when necessary.
<br>Establishing Section policy, determining enforcement priorities, developing internal processes, and overseeing budget and personnel planning.
<br>Ensuring consistent training for Section attorneys and non-attorney staff on evolving disability rights law, litigation strategy, and agency priorities.
<br>Leading outreach and education efforts with law enforcement, public entities, advocacy organizations, and other stakeholders to promote ADA compliance and systemic reform.
