Job Description:
JOB SUMMARY
Oversees the administration and prosecution of all felony drug cases and supervises unit personnel to provide input on annual merit-based reviews.
Responsible for the review and approval of all civil forfeiture actions and oversees all forfeiture matters generally.
Oversees consensual wiretaps for legal and evidentiary compliance and is responsible for filing the annual report to the Attorney General on wiretap reporting for Lancaster County.
Works closely with the Lancaster County Drug Task Force and completes and files all financial reports related to task force funding to the Office of Attorney General on a quarterly basis.
Will maintain an active caseload to include Drug Delivery Resulting in Death prosecutions.
ESSENTIAL JOB FUNCTIONS
The Assistant District Attorney who supervises the Felony Drug Unit must:
Oversee prosecution of all felony drug cases including active monitoring and supervision of all cases and unit members as well as approving plea agreements and providing plea negotiation advice.
Prosecute at all stages a full case load of felony drug cases including investigation review/consultation, approving drug related search warrants, preliminary hearings, bail matters, suppression issues and jury trials.
Must be an expert in the laws of search and seizure and be able to conduct suppression hearings and draft suppression briefs with regularity.
Must be knowledgeable in all aspects related to the sale of controlled substances to include, value, weights, packaging, terminology, and usage;
Oversees all Drug Task Force operations for legal compliance.
Responsible for overseeing all forfeiture matters, including review and signing of forfeiture petitions/orders, responding to motions and conducting civil forfeiture hearings; must be familiar with the civil rules of procedure and motions practice.
Reports directly to the First Assistant District Attorney concerning unit case status and unique unit issues of which there are many. This area is constantly presented with new drugs as well as unique legal challenges for prosecutors. Thus, this position requires an absolute expert in their field of practice.
Provide local trainings for municipal and PSP law enforcement agencies on legal updates. Recommend appropriate procedures for the District Attorney’s consideration for local implementation.
OTHER TASKS AND DUTIES
Represent the office in court calendar assignments
Handle questions from and advise police officers and less experienced prosecutors on cases and law.
Respond to crime scenes to assist investigations as needed.
Act as Duty DA and be on call for off-hours for the office on a rotating basis.
Perform other duties as assigned
MINIMUM QUALIFICATIONS
Juris Doctorate degree
Licensed to practice law in the Commonwealth of PA
KNOWLEDGE, SKILLS AND ABILITIES
Must be an expert in PA criminal prosecutions particularly of felony drug cases and search and seizure law.
Must be able to direct a felony drug investigation and prosecution and drug delivery resulting in death investigation and prosecution.
Must have working knowledge of Title 18 Chapter 57, Wiretap Act and Title 42 Chapter 58, Forfeiture Act.
Must also have command of the Rules of Evidence and be a litigation expert.
REQUIRED LICENSES, CERTIFICATIONS AND CLEARANCES
Successfully meet the requirements of the criminal history background check.
