The South Dakota Board of Regents is hiring an Assistant General Counsel to join our team. In this role, you’ll handle a wide range of legal matters that touch every corner of higher education—employment and personnel, contracts, student affairs, FERPA compliance, public records requests, Title IX, academic freedom, intellectual property, risk management, and more. You’ll be part of a small, dedicated team serving the state’s public universities, helping to navigate complex legal issues while supporting students, faculty, and staff.
Under the direction of the SDBOR General Counsel, the Assistant General Counsel, provides comprehensive legal advice to system staff and institutional leadership on federal regulations, state law, administrative rules, Board of Regents policies, and other higher education legal topics. Key responsibilities include advising Human Resources and Student Affairs offices on student and employment-related issues, reviewing, drafting, and analyzing contracts, conducting legal research, and supporting the development of policies and procedures. Additionally, this role will involve managing subpoenas and public records requests, assisting with grievance processes, and handling a variety of higher education legal matters, including Title IX, Clery Act, and the Family Educational Rights and Privacy Act (FERPA), as directed by the General Counsel.
Minimum Qualifications Education and Experience
- Juris Doctorate degree.
- 3 or more years’ experience practicing law in a related field.
- Currently licensed to practice law in South Dakota, or ability to obtain licensure to practice in South Dakota within one year of hire.
- Varying levels of experience may be acceptable to the hiring manager.
Preferred Qualifications
- Experience practicing law in higher education, government practice, compliance, litigation, administrative or civil actions, employment or related area.
