Associate Vice President, Head of US Compliance

Responsibilities:
Compliance Leadership and Strategy:
  • Develop, implement, and maintain a comprehensive compliance program in alignment with federal, state, and local regulations, including but not limited to the OIG and DOJ Guidance for Effective and Robust Compliance Programs.
  • Provide strategic direction and leadership to the US compliance team, ensuring alignment with corporate goals and regulatory requirements.
  • Serve as a key advisor to the Global Vice-President, Chief Compliance & Privacy Officer & the General Manager/President of Ferring Pharmaceuticals, Inc. on US Healthcare compliance-related matters as well as general Compliance matters, except Ethics which is separately managed at Ferring globally.
  • Embrace and implement opportunities to rethink how Compliance services are provided, focusing internal expertise on complex, high value matters, and automating, streamlining, or outsourcing high-volume, lower complexity matters, and using data to drive continuous improvement in services.
Regulatory Compliance:
  • Ensure compliance with FDA, DOJ, OIG, and other relevant regulatory agencies’ guidelines and requirements, including but not limited to the PhRMA Code.
  • Monitor changes in laws, regulations, and industry standards, including advisory notes from the aforementioned authorities, decisions and settlements with other pharmaceutical companies; assess the impact on the company and implement necessary changes.
Risk Management:
  • Identify, assess, and mitigate healthcare compliance risks across the US organization.
  • Conduct regular healthcare compliance risk assessments and audits to ensure the effectiveness of the US compliance program.
  • Develop and implement corrective action plans for resolution of problematic issues and provide general guidance on how to avoid or deal with similar situations in the future.
Training and Education:
  • Develop and deliver training programs to ensure that employees are aware of compliance policies and procedures, inputting all in-scope compliance policies and procedures into the enterprise training matrix.
  • Continuously drive the US Compliance team improve LMS and in-presence training sessions across the organization.
Investigations and Reporting:
  • Chair the US Compliance Committee.
  • Work with Legal and HR team members on compliance issues and incidents, as part of the US Investigations Oversight Committee.
  • Ensure timely and accurate reporting to headquarters and US President of Ferring Pharmaceuticals, Inc.
  • Maintain good records of compliance activities, investigations, and outcomes.
Collaboration and Global Alignment:
  • Work closely with other departments, including Legal, Medical, US Commercial and Marketing, Finance, Regulatory Affairs, Quality Assurance, and Human Resources, to ensure a coordinated approach to compliance.
  • Collaborate with relevant stakeholders to ensure alignment of compliance programs and policies across the organization.
  • Represent the US compliance function in cross-functional teams and global initiatives.
  • Act as lead US Healthcare Compliance Officer, advisor, and business partner to provide guidance and leadership in matters related to marketing, medical, clinical, and other commercial business activity.
  • Provide guidance and support to the commercial and medical teams on compliance-related matters.
  • Ensure that all commercial and medical practices align with regulatory requirements and company policies.
People Leadership and Team Development:
  • Lead, mentor, and develop high-performing US compliance team members.
  • Foster a positive, diverse and inclusive work environment that encourages team collaboration and professional growth.
  • Conduct regular performance evaluations, provide feedback, and support career development opportunities for team members.
  • Contribute to the CCO’s preparation of the global headcount & budget planning process by developing plans to support business strategy, financials, and organizational structure.

Requirements:
  • Bachelor’s degree in a relevant field; advanced degree (JD, MBA, PharmD) preferred.
  • A minimum of 15 + years of pharmaceutical industry experience, and formal education in the health science area, as well as at least 10+ years of experience within compliance function.
  • Proven track record of leading and managing a sizeable compliance team or function within a biopharmaceutical company.
  • Experience involving the implementation of compliance program and a full understanding of US pharmaceutical regulatory environment and other regulations (including but not limited to FDA, PhRMA, DOJ, OIG, etc.).
  • Demonstrated experience in creating and delivering effective compliance training.
  • Knowledge of Patient Protection Affordable Care Act (PPACA) – Sunshine Act; Federal Food, Drug,
  • Cosmetic Act; Anti-Kickback Statute; and federal and state transparency and disclosure laws.
  • Current knowledge of ongoing compliance and federal and state enforcement activities.
  • Knowledge and understanding of pharmaceutical, HIPAA and compliance issues.
  • Ability to travel domestically and internationally (up to 30% per year). Some months may require more travel.
  • Certification in compliance (e.g., CCEP) preferred
  • High adaptability to a different corporate culture (small to midsize multinational, privately held pharmaceutical company, European culture).
  • Strong presentation skills, from small groups (20-30) to large audiences (500-1000+).
Role will be in Parsippany, NJ. As a people leader, you may be expected to forgo your single day of weekly work from home for team matters.

Our Compensation and Benefits
At Ferring, base salary is one part of our competitive total compensation and benefits package and is determined using a salary range. The base salary range for this role is $259,000 to $312,000, which is the reasonable estimate of the base compensation for this role. The actual amount paid may differ based on non-discriminatory factors such as experience, knowledge, skills, abilities, education and primary work location. Additional compensation for this role will be provided based on competitive annual incentive compensation targets in the form of an annual bonus - payouts are based on individual and company performance.

Benefits for this role include comprehensive healthcare (medical, dental, and vision) with a premium differential, inverse to base salary, to be paid by employees, a 401k plan and company match, short and long-term disability coverage, basic life insurance, wellness benefits, reimbursement for certain tuition expenses, sick time of 1 hour per 30 hours worked, vacation time for full time employees to accrue up to 120 hours in the first four (4) years of employment, and 160 hours in the fifth (5th) year of employment as well as 15 paid holidays per year.
