Attorney - MCA Litigation

About Us:
We are a Miami-based debt restructuring firm that represents small business owners facing aggressive collection actions from creditors and merchant cash advance (MCA) lenders. Our mission is to protect clients from predatory lending practices, negotiate fair settlements, and provide strong legal advocacy throughout the resolution process.

Position Overview:
We are seeking an Attorney licensed to practice in New York with experience representing clients in disputes against creditors and MCA lenders. The ideal candidate will have a solid background in creditor/debtor law, commercial litigation, or financial dispute resolution, and will be comfortable managing cases involving MCA contracts and collection actions filed in New York.

Key Responsibilities:

• Represent and advise clients in disputes against creditors, MCA lenders, and related financial institutions.
• Draft, file, and respond to pleadings, motions, and discovery requests in New York courts.
• Negotiate settlements and workout agreements with opposing counsel.
• Analyze MCA contracts and identify defenses including usury, fraud, and unconscionability.
• Collaborate with internal negotiators and case managers to develop defense strategies and resolution plans.
• Maintain accurate case documentation and ensure compliance with all applicable laws and court procedures.

Qualifications:

• J.D. from an accredited law school.
• Active license to practice law in New York (required).
• Based in or willing to work from Miami, FL
• 2–5+ years of experience in creditor/debtor law, commercial litigation, or financial services defense.
• Prior experience handling merchant cash advance (MCA) matters is strongly preferred.
• Excellent negotiation, research, and written/oral advocacy skills.
• Ability to manage a high-volume caseload independently and efficiently.

Job Type: Full-time

Pay: $80,000.00 - $100,000.00 per year
