Job Description

Job Overview:

The Chief Assistant Prosecuting Attorney is responsible for overseeing criminal prosecutions and ensuring the fair and efficient administration of justice. At the direction of the Lake County Prosecuting Attorney, the Chief Assistant Prosecuting Attorney is responsible for performing any and all duties set forth by the Constitution and statutes of the State of Michigan. The Chief Assistant Prosecuting Attorney will provide legal guidance and support to law enforcement and work with other county officials to uphold the rule of law in Lake County.

Responsibilities and Duties:

Appears in Court for all phases of felony, misdemeanor, and delinquency litigation in the Lake County Trial Court. Authorizes requests for warrants as appropriate in accordance with legal standards and requirements. Negotiates pleas and sentencing recommendations with attorneys and defendants to resolve pending criminal cases. Performs all research and preparation needed to appear in court for the prosecution of felony, juvenile, and probate cases.
Drafts motions, briefs and other legal documents. Assumes responsibility for all office functions in the absence of Prosecuting Attorney.

List of Responsibilities and Duties:

  • Regularly appear in court for arraignments, motions, trials, preliminary examinations, sentencing, and other proceedings.
  • Review requests for criminal charges from State and local law enforcement agencies.
  • Review requests for search warrants under applicable probable cause standards.
  • Engage in negotiations for plea resolutions within guidelines established by the Prosecuting Attorney which comport with legal standards.
  • Research legal and factual issues required at all phases of litigation.
  • Interview witnesses to resolve legal and factual claims when needed.
  • Take reasonable steps to ensure witnesses are present and prepared to testify when needed.
  • Work in cooperation with law enforcement officers and other investigators to ensure legal standards are followed.
  • Assist the Prosecuting Attorney in supervisory and administrative duties as assigned.
  • In the absence of the Prosecuting Attorney, the Chief Assistant Prosecuting Attorney must take on all responsibilities of the Prosecuting Attorney.

Minimum Qualifications:

JD from an accredited law school

List of Qualifications:

  • Must be licensed or able to become licensed to practice law in the State of Michigan.

Additional Qualifications:

Applicants must possess an ability to maintain the confidentiality of information and materials which may be highly sensitive.
